party of the first part, and HANS NOOR, residing at 22 Ivy Street,
Farmingdale, New York, and MARY E. NOOR, his wife, residing at the
same address,
party of the second part,

lying and being in the Town of Southold, Suffolk County, New York, at Fleets
Neck, Cutchogue, bounded and described as follows:
BEGINNING at a point on the southerly line of West Road distant
South 65 degrees 22 minutes 40 seconds West 140 feet from a point on
the southerly side of West Road where the southerly line of West Road
! is intersected by the westerly line of lands now or formerly of J. R.
c Nagle; THENCE from said point of beginning running along other lands
of W. Harry Lister the following two courses and distances :
(1) South 24 degrees 37 minutes 20 seconds East 220 feet; and =
(2) South 20 degrees 22 minutes 40 seconds West 95. 50 feet to the
ordinary highwater mark of Wickham Creek; THENCE northwesterly along
the said ordinary highwater mark of Wickham Creek on a tie line
course of North 69 degrees 04 minutes 30 seconds West a distance of
372.82 feet to a point on the southerly side of West Road; THENCE
North 65 degrees 22 minutes 40 seconds East along the southerly side
of West Road 304.85 feet to the point or place of beginning.
TOGETHER with all the right, title and interest of the party of the _-
first part in and to the lands lying under the waters of Wickham
E eek adjacent to said premises, and TOGETHER with all riparian rights

premises which fronts on Wickham Creek.

TOGETHER with all right, title and interest,if any, of the party of the first part of, in and to any streets sad _
roads abutting the above-described premises to the center lints thereof; TOGETHER with the appurtenances
c and all the estate and rights of the party of the first part in 2n to said premises; TO HA AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of

AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
24 any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires..
