THIS INDENTURE, made the 24th day of October ,nineteen hundred and seventy-two

party of the first part,and FRANK D. OLIVER and CLOTILDA OLIVER, his wife, resid-

WITNESSETH,that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby rant and release unto the party of the second part, the heirs
or successors and assigns of the party of the sec d part forever,
ALL that certain plot, piece or parcel of land with the buildings and improvements thereon erected shells e
lying and beingloau at Mattituck, in the Town of Southold, County of Su folk
lend State of New York, known as Lots 6, 7 and S on the Map of Mattituck
Heights, Subdivision Map of property of Gustav Bayer, situate at Matti-
tuck, Suffolk County, New York, surveyed by Otto W. Van Tuyl, Licensed

I00JECT to covenants and restrictions of record affecting said premises.
Ii TOGETHER with the use of a right of way eight feet wide, to and from
Wickham Avenue to Long Creek, a branch of Mattituck Bay, to pass and
repass on foot only; said right of way commencing at the northerly
junction of Middle Road and Wickham Avenue at a concrete monument;
�) ! running in a westerly direct eight feet; thence running in a northerly
direction one hundred thirty feet parallel with the boundary line of
Hubert We Klein and Gustav Bayer to mean high water mark of Long Creek;
thence running in an easterly direction along Long Creek to land of
Hubert We Klein; thence running in a southerly direction along the
, western boundary of Hubert W. Klein, one hundred thirty feet to a con-
crete monument, the northerly Junction of Middle Road and Wickham Avenue
the point or place of BEGINNING.

w v TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and

HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of

LU U AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
ti AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
