THIS INDENTURE, made the grid day of August nineteen hundred and seventy-two, BETWEEN THEODORE STEVENS, residing at Greenwich Street (no number) , Montauk, New York, and THEDA S. SHULHA, residing at Mill Road, (no number) , Mattituck, New York, NO the last will and testament of STAMPS as executors of late of REQUIRED STEPHEN STEVENS County of Suffolk and State of New Yorkdeceased, party of the first part, and el THEODORE STEVENS, residing at Greenwich Street (no number) , Montauk, New York, party of the second part, WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last will and testament, and in consideration of ONE and 00100--(11.00)--DOLLAR, paid by the party of the second part but in accordance with the Last mat Will and Testament of said decedent does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, CC ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being iaAlmc at Mattituek, Town of Southold, County of Suffolk and INU-N tate of New York, bounded and described as follows: BEGINNING at a point on the easterly side of Mill Road at the north- westerly corner of the premises herein described adjoining land of Wolbert on the north; running thence along said land of Wolbert South 84° 34' 30" We East 240.0 feet; thence along land of Joseph Carlton South 83° 03 ' 50" IEast 315.97 feet to land of Reilly; running thence along said land South ` ' °•• 90 20' 20" West 151.43 feet to land of Anna Stevens and Theda Stevens, now Theda S. BEING AND INTENDED TO BE the northwest half of the real property of said decedent, Stephen Stevens, as devised in Paragraph Fourth of his Last Will and Testament, probated in the Suffolk County Surrogate' s Court on April 20, 1972• rn Cl) O TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads'abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, G and also all the estate which the said decedent had at the time of decedent's death in said premises, and also rrt the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. r a.. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. _ The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
