THIS INDENTURE,made the 18th day of March nineteen hundred and seventy four

party of the first part,and
Frank Swotkewicz , residin,ff at Herricks Lane, Box 95,
Jamesport, New York,
party of the second part,
WITNESSETH,that the party of the first part,in consideration of
ten dollars,
lawful money of the United States, and other r-ood and valuable consideration paid
j ^ by the party of the second part, does hereby grant and release unto the party of the second part,the heirs,or succes-
sors and assigns for the party of the second part forever,
ALL that certain plot,piece or parcel of land,wt�dgilr BIss11,d,situate,lying and
beinginthe Town of Southold, County of Suffolk and State of New York,
known and designated as Lot No. 17 on a certain map entitled "Nap
of Rosewood Estates" and filed in the office of the Clerk of the
County of Suffolk on January 24, 1969 , as Map #524C.
Being and intended to be a part of the premises conveyed by Irving;
L. Price, Jr. , Referee , to John Koroleski and Rose Koroleski, his
wife, the party of the first part, by deed dated October 29, 1964,
recorded Liber 5645 op 359.
Subject to the following covenants and restrictions which are to
run with the land, and which are to bind the above lot, and all
the other lots shown on said map.
1. Owners of the lots are to comply with all zoning, building and
health laws of the Town of Southold and the County of Suffolk.
2. Water supply and sewane disposal plans are to be as approved
by Suffolk County Board of Health.
3. No business shall be conducted on the premises . No pigeons or
livestock shall be kept on the premises.
4. No building shall be erected on any of the lots unless plans and
specifications have been approved in writing by seller. Future im-
provements to the outside of any structure must also be approved
by seller.
5. No trailers shall be placed or stored on the premises.
6. No outbuildings shall be erected on the premises .
7. No fences of any kind shall be erected on the premises .
8. All houses on the lots are to be set back at least 50 feet from
Rosewood Erive, with the exception of lots numbers 1 to 6 inclusive,
which may have a smaller setback, and lot #21 may be set back 35
feet from the line of the roadway on the north.
9 . only a one-family house may be erected on each lot.
10. All houses must have a minimum area of 1300 square feet of livable
area (does 'not include garage , porch, attic or basement) .
11. Any garage , whether a one- or two-car type must be attached
to the house .
12. Seller reserves the right to install telephone, electric and other
utility lines in the streets, and to dedicate the streets to the Town
of Southold for highway purposes.
