Southold Town Board of Appeals
June 26, 1958
A regular meeting of the Southold Town Board of Appeals was held at 7:30
P.M. on Thursday, June 26, 1958, in the Town Clerk's Office, Southold, New York.
There were present: Mess~s. Robert W. Gillispie, Jr.; Chairman, Robert
Bergen, Herbert Rosenberg and Charles Grigonis, Jr.
Absent: Mr. Serge Doyen, Jr.
Also present: Mr. Howard M. Terry, Building Inspector
PUBLIC HEARING: Appeal No. 68 on application of Baker & Fickeissen, Boisseau
Avenue, Southold, New York~ on behalf of Harold_~ Hol~berg, North Road, Greenport,
N.Y., for a variance to the Zoning Ordinance under Article III, Section 907.
The Chairman opened the hearing by reading the appeal, letter to applicant
advising of date of public hearing and legal notice of hearing with affidavit
attesting to publication.
Chairman: Is there anyone present who wishes to speak for this appeal?
Mr. Holmberg: I just wish to say that the garage was built long before the
enactment of the Zoning Ordinance and I have now retired and we are m. king this
our home now and the garage is not large enough to store my car and boat during
the winter months.
Location of property: North side of North Road, Route 27A, Greenport, N.Y.
The Chairman then asked if there wets anyone who wished to speak against the
appeal and as there was no response the Board reviewed the application and
unanimously granted the variance. It was the Board's determination that the
strict application of the Ordinance would produce undue and unique hardship as
the house and garage were built before the enactment of the Ordinance and the
additional 8 foot garage space was needed in this particular instance and most
all neighboring properties had sufficient garage spacer and this additional
8 foot added to the existing garage would not affect the character of the district.

Minutes of the June 12th meeting were read. On motion duly made by
Mr. Rosenberg, seconded by Mr. Bergen, and carried, ~inutes were approved as
submitted.
The Chairman advised the Board members that he had been asked by Mr.
Charles M. King for a written interpretation of the stipulation in the
special exception which was granted to him t~ erect a gasoline station.
The Secretary was directed to write Mr. King advising that the Board's inter-
pretation, concerning the erection of a gasoline station, with pumps, lubrica-
ting and other devices, all fuel oil and similar substances to be located or
stored at least fifteen (15) feet from any street or lot line, would apply to
any new installations.
PUBLIC HE~RING: Appeal No. 67 on application of Nick Houlis, Bay Avenue,
East Marion, New York, for a special exception to erect directional signs under
Article III, Section 300, Subsection ll of the Zoning Ordinance.
After reading the application, letter to applicant advising him of date of
public hearing and legal notice of hearing with affidavit attesting to publica-
tion, the Chairman asked if there were anyone present who wished to speak either
for or against this appeal. There was no response to the Chairman's question and
the Board unanimously grante~ the special exception as follows: Permission was
granted to erect a 2' x 3' directional sign on north side of North Road (Route 25)
at the intersection of ~Ain Street, Greenport, N.Y., for a period of 4 months.
Thi? permission to be renewable providing permission is granted by the owner of
the property, unless revoked by the Board of Appeals. ChairmAn read letter from
Mr. A. A. Straussner, owner of property, granted Mr. Houlis permission to erect
this sign.
In the absence of authorization from Charles King granting Mr. Houlis
permission to erect a 3t x 3' sign at the Shell Station, North Road, Greenport,
N. Y., it was the unanimous decision of the Board to continue this part of the
appeal until such permission is obtained and the special exception for this sign
was not granted at this time.
PUBLIC HEARING: Appeal No. 69 on application of Harold R. Reeve & Sons,
Main Road, Mattituck, New York, on behalf of John Gunther, Mattituck, N. Y., for
a variance due to lack of access. Location of property: Knollwood Terrace,
Mattituck~ N.Y.
Chairman read the appeal, letter to appellant advising of date of public
hearing, legal notice with affidavit attesting to publication and Notice of
Disapproval by the Building Inspector on application of Harold R. Reeve & Sons
for permit to build.
There was no response to the Chairman's questioning as to whether there was
anyone present who wished to speak either for or against the appeal. ~t was the
determination of the Board that this appeal be granted as the lot is of ample
size and the private right of way is only means of access and has been in exist-
ence for some time. Approval of access was unanimously granted as follows: A
20 foot right of way bordering the westerly line of Lot No. 7 to Lot No. 5 at
Knollwood Terrace, Nattituck, New York.

PUBLIC HEARING: AppeaX No. 71 on application of Andrew Cook of Mill Road,
Mattituck, New York, for a special exception to the Zoning Ordinance, under
Article III, Section 300, Subsection 11, for permission to erect direction
advertising signs.
The Chairman opened the hearing by reading application, letter to ~. Cooke
advising of date of hearing and legal notice with affidavit attesting to the
publication of notice in the local newspaper.
Chairm~_n asked ~. Cooke, who was present at the hearing, to identify all of
the locations for the proposed signs as the Board could not grant a blanket
exception.
Since there was no one present who wished to speak either for or against
the exception the Board nna~imously granted the special exception for the
following signs, with the understanding that all signs are to be erected in
accordance with the Ordinance and approval withheld until Mr. Cooke produces letters
of permission from the owners of the property on which the five signe are to be
erected. The approval of these locatiols may be revoked for cause:
1. Directional arrows to the Anchor Inn (4' x 1') on the south east side of
Aldrich Lane and Sound Avenue.
2. Directional sign (4' x 1') north east corner Route 25 and Aldrich Lane.
3. Directional sign (4' x 1') north west corner Route 27A and Westphalia Road.
4. Directional sign (4' x 1') west side of Westphalia and Cox Neck Roade
5. Illuminated flourescent box type sign (4' x 4') north west corner of
Sound Avenue and Cox Neck Road.
P~LIC HEARING: Appeal No. 70 on application of Leroy S. Reeve, Mattituck,
New York, account of Peter Kreh, Jr., Mattituck, New York, for variance to the
Zoning Ordinance nnderArticle III, Section 303 and Section 280A, Subsection 3.
Location of property: West Side of Bay Avenue, Mattituck, N.Y., approximately
95.94' x 150', slightly irregular shape.
Chairman opened the hearing by reading application, letter to Mr. Reeve
advising of ~ate of public hearing and legal notice of publichearing with
affidavit attesting to its publication in the local newspaper.
Chairman: Is there anyone present whowishes to speak for this application?
Mr. Kreh: There are two houses on this piece of property now, which have been
in existence prior to the enactment of the Zoning Ordinance and I wish to sell
the one house and lot in the rear.
After review of the application and accompanying map Board unanimously granted
variance on the rear lot, size of which is now established as 95.94' in width, with
a depth of 150', slightly irregular shape. Right of access was granted as follows:
Access to the westerly lot, as described on Map by O. W. VanTuyl &Son, dated
~ept*mber 12, 1957, 12 feet in width to a depth of 178 feet from Bay Avenue,
bordering southerly line of property now of Peter F. Kreh, Jr.

P~BI.!C BEARING: Appeals No. 73 on application of the Peconic Outdoor Advertis-
ing Company, Arshamomaque, Southold, New York, for permission to erect an advertis-
ing sign as a special exception to the Zoning Ordinance.
Ohairman opened the hearing be reading application su~itted by Mr. Stanley
S. Corwtn, attorney for Mr. Robert S. Witherspoon of the Peconic Outdoor Advertising
Company, letter which was sent to Mr. Corwin and Mr. Witherspoon advising of the
date of public hearing, legal notice with affidavit from local newspaper attesting
to its publication and letter from Mr. Arthur Nehl of the North Fork Variety Store
granting permission to erect one 5' x il' steel sign on or against the westerly
wall of his premises at Cutchogue, New York, subject to the approval of local
zoning regulationse
The Chairman then asked if there were anyone present who wished to speak
either for or against the appeal.
Mr. C~rwin stated that unless they received consent from the Board to erect
the s~gn in question, which would advertise products other than those sold on the
premises, it would greatly ha~per their business.
Mr. Witherspoon explained that basically he sells advertising space and, the
sign in question would be bought for a period of two months by the Wise Potato
Chip company and by other organizations for period of perhaps from two to four
months at a time. He stated that the ~roducts advertised would be nationally
known products and would not necessarily be those sold on the premises.
Mr. Rosenberg explained that the Ordinance specifically states that the signs
permitted are those that announce the business in which a person is engaged and
the business conducted therein.
After lengthy discussion it was the determination of the Board to continue
the hearing until the next meeting, to be held on July 10th, at which time a
decision on the appeal would be made.
