The following action was taken by the Board of Town Trustees
during their regular meeting held on February 28, 1989 as follows:
WHEREAS the Town Trustees have conducted an on site inspection
of the subject property.
RESOLVED that the Town Trustees approve the request made by
Proper-T Services for a waiver to construct an addition to existing
single family dwelling located at 800 West Creek Road, Cutchoque,
N.Y., identified on Suffolk County Tax Map as 1000-103-13-6.
Please return to the Building Department for a determination on
the need for any other permits which may be required for this project.

Dear Sir/Madam:
Records of this Department indicate that you are in violation of
the Environmental Conservation Law (ECL):
Article 15, Rrotection of Waters, Section 15-0501.1, 503.1,
0505.1
X Article 25, Tidal Wetlands, Section 25-0401.1
in that you caused, or permitted to be caused: The excavation and
construction of three cinder block foundations in an area adjacent to a
regulated tidal wetland without permit to. do so.
A violation of this/these Articles of ECL is a misdemeanor and is
punishable by a fine of not more than $3,000 and/or $8,000 per
violation.
You are, hereby, advised to cease your operation at the referenced
location immediately. Please contact this office at once so that we
may attemPt to resolve this matter. A failure to contact this office
within 3D days will result in this matter being referred to the
'Department's Regional Attorney for legal action.

Property of Barbara Schubeck Barrett
Dear Mr. Hamilton:
Proper-T Services represents Mrs. Barrett in seeking permis-
sion to construct an addition to her residence under the appli-
cation referenced above. All contact with the Department of
Environmental Conservation has been through Proper-T Services.
My first knowledge of the existence of a Notice of Violation
came yesterday when I spoke to Mr. Enrico of your office on
the telephone. He said that a copy.of the Notice had not been
sent to Proper-T Services, but he would now send me a copy.
In the meantime, I contacted Mrs. Barrett and obtained a copy
of the Notice by fax from her today.
Being unfamiliar with established procedures, she had over-
looked the requirement that your office be contacted by April
24th, and for this we both apologize.
I am sure that the matter can be resolved, and I will call
your office on Monday to make an appointment for a meeting. I
tried several times this afternoon to reach both you and Mr.
Enrico, with no success.
Again, I am sorry for the problem and I will call you forth-
with.

expand the home of Barbara Schubeck Barrett~ located at 800
West Creek Avenues Cutchogue (Tax Map No. 1000-!03-18-8). The
project is located more than 75 feet from wetlands or a body
of water~
Proper-T Services represents Mrs. Barrett in this matter~ and
a letter of authorization is enclosed.
I would appreciate it if you would confirm that the project
does not require a wetlands permit from the Trustees, in order
that the application for a building permit may proceed expedi-
tiously.

The enclosed photo of the Barrett property may be of value to
the Trustees in making the inspection of the property sched-
uled for Thursday, February 23rd.
The stake circled in red in the photo is 80' from the proposed
new construction. The stakes are each marked with the distance
from the seaward edge of the foundation for the proposed expan-
sion of the dwelling.
