Box 1179 Southotd, New York 11971 SOUTItOLD TOWN CONSERVATION ADVISORY COUNCIL The following resolution was adopted at the meeting of the Southold Town Conservation Advisory Council held AUCUST 26, 1996: WR-[t8 Moved by Bruce Loucka, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Waiver Request of THOMAS and BARBARA BALL 66-2-46 to construct a 3' x 15' deck. 1890 Arshamomaque Avenue, Southold The Council recommends that the Trustees require a permit for the project, This type of project could create more runoff and a non-turf buffer should be required next to the bulkhead. Vote of Council: Ayes: Bruce Loucka, John Hagerty, Robert Keith, Kenneth Meskill, Betty Wells, Christy Paliouras and Shannon Reidy. Abstain: Allan Connell Motion carried. Albert J. We would like .to construct the proposed deck shown on the survey at this time. The deck Will be attached to the house and extend out 15 feet. The rear of the house is 30 inches off the ground and a deck is the best way to fie in the rear entrances (four sliding glass doors). Landward of a substantial man-made structure greater than 100' in length which was constructed prior to ~/20/77. Landward of the 10' above mean sea level elevation contour on a gradual, natural slope. Landward of the topographic crest of a bluff cliff or dune which is greater than 10' ~n elevation above mean sea level. Therefore, no permit is required under the Tidal Wetlands Act (Article 25 of the Environmental Conservation Law). Please be advised, however, that no construction, sedimentation or disturbance of any kind may take place seaward of the 10' contour or topographic crest without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vecetation in this area as a result of your project. Such precautions may include providing adequate work area between the 10' contour or topographic crest and the project (i.e. a 15' to 20' wide construction area) or erection of a temporary fence, barrier, or hay bale berm. Please note that any additional work, or modification to the projePt as described, may require authorization by this Department. Please contact this office if such are contemplated. Please be further advised that this letter does not relieve you of the responsibility of obtaining any necessary permits or approvals from other agencies.
