SCHUHMANN and MARGARET SCHUHMANN, his wife, residing at 42B Little Neck Road, Cutchogue, New York 11935 , party of the first part, andRICHARD PERRY and PATRICIANS ERRY, his wife, /l residing at (no #) South Oakwood Drive, Laurel, New York, party of the second part, WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL, that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and beingjtrX*0c at Cutchogue, in the Town of Southold, County of Suffolk and State of New York, and bounded and described as follows: BEGINNING at a point on the easterly line of Little Neck Road 1, 192. 76 feet southerly along said easterly line of Eugene' s Road from } said point of beginning; running along land of Stepnoski, North 89° d// c 59 ' 30" East, 150 . 00 feet to land of Mary Zeneski; running thence along said land of Zeneski, South 000 00 ' 30" East, 150 . 00 feet to land now 1' or formerly of Morris; running thence along said land now or formerly of Morris, South 891 59 ' 30" West 150.00 feet to said easterly line of Little Neck Road; thence along said easterly line of Little Neck Road North 000 00 ' 30" West, 150. 00 feet to the point or place of beginning. -75d x h SUBJECT to covenants and restrictions of record affecting said t premises. SUBJECT to a mortgage held by Southold Savings Bank dated Q December 13, 1968 in the amount of $15,000 .00, and recorded in the Suffolk County Clerk' s Office on December 27, 1968 in Liber 5526 of mortgages at page 353, and on which said mortgage there is now due and owing the principal suttt_ of $14 , 170 . 04 and interest, and which said mortgage the party of the second part agrees to assume and pay. BEING AND INTENDED TO BE the same premises conveyed to the grantors herein by deed dated December 13, 1968 and recorded December 27, 1968 in the Suffolk County Clerk' s Office in Liber 6480 at page 124 . TOGET1IER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the renter lines thereof; TOGETHER with the appurtenances and allthe estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
