BURGGRAF and AGNES C. BURGGRAF, his wife, both residing at 185 Wetherill Road, Garden City, New York; party of the first part, and JOANNE E. Halsey, Southampton, New York, June 7, 1919", and filed in the Office of the Clerk of the County of Suffolk on t' '8/16/1922, as Map #156, bounded and described as follows: ` BEGINNING at a point on the easterly side of Nassau Point Road, where said road is intersected by the dividin§ line between Lot No. 3 and Lot No. 4; running thence North 78 36 ' 20" East along said dividing line, a distance of 391.09 feet to a point where the ordinary high water mark meets said dividing line; thence along the tie line connecting said point with a similar point where be ordinary high water mark meets the dividing line be- tween Lot No. 4 and Lot No. 5, South 5° 52 ' 30" East a distance of 100.00 feet; thence along said dividing line between Lot No. 4 and Lot No. 5, South 780 36 ' 20" West a distance of 382.00 feet to a point where said latter dividing line intersects the easterly side of Nassau Point Road; thence along the easterly side of Nassau Point Road, a distance whose tie line connecting the said latter point with the point where said easterly side of Nassau Point Road is intersected by the dividing line between Lot No. 3 and Lot No. 4 is North 11° 05 ' 30" West, a distance of 99. 54 feet to the point or place beginning. BEING and intended to be the same premises conveyed to the party of the first part by deed dated December 5, 1961, and recorded in Suffolk County Clerk' s Office on December 7 , 1961, in Liber 5093 at page 245. TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE A HOLD the premises herein granted unto the party of the second part, the heirs se successors and assigns of the party of the second part forever. r AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
