1 THIS INDENTURE, made the 4th day of October nineteen hundred and seventy four
BETWEEN RUSSELL L. TUTHILL, residing at 275 Bayer Road, Mattituck,
w N. Y.
and LORETTA J .MIKOLAJ 7YK his wife
party of the first part,and ZDZISLAW MIKOLAJCZYK` residing at 520 53rd Street,
Brooklyn, N. Ya

WITNESSETH,that the party of the first part, in consideration of ten dollars and other valuable consideration
k7 paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece orparcel of land, with the buildings and improvements thereon erected, situate,
lying and beingiIl,7W at Ma�tituek, Town of Southold, County of Suffolk,
and State of New York shown and designated as a portion of lots 20
to 23 inclusive on a certain map entitled "Amended Map of Mattituck
.- tteignts" ana riles in the orfice of the Clerk of the County of Suffolk
on March 25, 1927 as map No. 1184. Said portions of lots being more
particularly bounded and described as follows: BEGINNING at a point
on the new easterly side of Wickham Avenue distant in a generally
northerly direction 299. 67 feet as measured along the easterly side
of Wickham Avenue from its intersection with the northwesterly side
of. Bayer Road and running thence from said point or place of beginning
along the new easterly side of Wickham Avenue, the following two
courses and distances: 1) North 50 34' 40" East 32. 10 feet; and 2)
North 17°55' 40" East 161. 80 feet to the division line between lots
19 and 20 on said map; running thence along said division line South
580 55' 30" East 200 feet to the division line between lots 20 and 33
on said map; running thence along said division line and the division
lines between lots 21 and 32 and lots 22 and 31 on said map South 310
04' 30" West 115.69 feet to the division line between lots 22 and 23
on said map; running thence through lot 23 on said map North 84° 17'
30" West 165.32 feet to the easterly side of Wickham Avenue and the
point or place of BEGINNING.
TOGETHER WITH the use of a right of way eight feet wide, to and
from Wickham Avenue to Long Creek, a branch of Mattituck Bay, to pass
and repass on foot only, said right of way commencing at the northerly
junction of Middle Road and Wickham Avenue, at a concrete monument,
running in a westerly direction eight feet, thence running in a north-
erly direction one hundred thirty feet parallel with the boundary line
(SEE RIDER ANNEXED)
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
ac AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indentpre so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
