THIS INDENTURE,made the 4th day of April nineteen hundred and seventy—three
BETWEEN LOURICE A. STAPLES, residing at 37 Lanier Lane, Bay
Shore, New York,
party of the first part, and DIANE S. PRATT, rewiding at Bay Avenue,
Cutchogue, New York,
party of the second part,
WITNESSETH,that the parry of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever, `
w ALL that certain plot, piece or arcel of land, with the buildings and improvements thereon erected, situate,
lying and being Wde at CUchogue, Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at the Northeasterly corner of the herein described
�I O premises on the Southwesterly side of Cox' s Lane, said point
of beginning also being where the division line between premises
herein described and the land of McBride intersects the South-
westerly side of Cox's Lane;
RUNNING THENCE South 49 degrees 01 minute 50 seconds East along
the Southwesterly side of Cox' s Lane, 179.54 feet to land of
N Glover;
THENCE along said last mentioned land, the following two (2)
courses and distances:
(1) South 54 degrees 55 minutes West , 500.0 feet ;
(2) North 49 degrees 01 minute 50 seco$ds West, 179.54 feet to
land of McBride;
THENCE North 54 degrees 55 minutes East along said last mentioned
land, 500.0 feet to the Southwesterly side of Cox's Lane, the
point or place of BEGINNING.
SUBJECT to a first mortgage lien in the amount of Nine Thousand
Ddlars ( $9 ,000.00 ) held by Leander B. Glover . Jr. , dated December
12 . 1972 .
BEING AND INTENDED TO BE the same premises conveyed to the grantor
herein by deed dated Dewnber 12 . 1972 recorded January 5,1973 in the
Suffolk County Clerk ' s Office in Liber 7317 , cp 492 .
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first pant covenants that the party of the first part has not done or suffered anything
wherhby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF,the party of the first part has duly executed this deed the day and year first above
written.
