Abatelli, Route 25, East Cutohegue~ New York. Fee paid $15.00. Request for a spesial exception to erect a 25 f~t flag pele on the preaises to fly an advertising flag, 5' x 8', with the words "Real Estatee on it. Chairman read the application, letter to applicant advising of date of public hearing and asking for information as to the size of flag and the lettering to be use~, Mr. Abatelli's reply with the requested information and legal notice of public hearing with affidavit attest~-~ to its publication in the local newspaper. Minutes of the August 21st meeting were read. On motion made by Mr. Grigonis, seconded by Mr. Bergen, and carried, Minutes were approved as submitted. -2- Board of Appeals August 28, 1958 MINUTES, Continued Chairsan~ Is there anyone present who wishes to speak for this application? Mr. Abatelli~ Mainly I want to fly the American flag and maybe have an adver- tising flag. The oi~ company sign obstructs ~y sign as tha~ sign of mine is obliterated by their sign. I appealed to them and asked them to remove their sign and I was willing to pay for the cost of removing it hut they said they could not do it. 0hair~an~ How big is your sign and how big is the Oil Company sign. Mr. Abatelli~ ~ sign is about 6' x 8' or 5' x 8'. It is about 9' offthe ground and their sign is about the same height. ~ sign is flood lighted from tho ground. Their's is lighted at the bottom of the circle on each side. Would it help you any to raise the present sign. Mr. AbAtelli: No it would not. The pressure of the wind would be bad if the sign were raised. Mr. Resenberg~ Do you happen te recall how ~any signs you have in the Township Mr. Abatelli? Fren Laurel, east? Mr. Ab~telli~ The big signs are from Queens te the border of Southold. I have one big sign, 1Ox12 feet on Route 27A on a building. Mr. Rosenberg~ Do you have any small signs that are not on property for sale? Mr. Ahatelli~ No. Chair~ant In other words if you have 25 pieces of property for sale you will have 25 ~ signs. Is there anyome else who would ~e to speak for this appeal? Awy questions? Is there anyone who wo,,!d like to speak against it? I would like to say that pers~_.lly I aa not in favor of flags in general -nless they are American flags and this type of evasion of the true function of a sign. M~st people are dead agaimst ~-y advertising signs in the Town and I th~w~, that if we should grant this exception we would be creating a precedent for the future. Mr. Abatell~ Suppose we Just want to put up a flag pole and fly the a-~rican flag. Chair~-n~ We have no control over that. I aa ~ars that you would be permitted to erect a flag pole to fly the American flag Just as a~Fone else in the Town would be and you would not have to come to us for per~issiom to do this. By resolution of the B~ard it was determined that this ~pecial exception should not be granted. The Beard is unwilling te establish a precedent which would open the door to various types of advertising other th_~ sign advertising. It is felt that the applicant is able to advertise far more effectively as a real estate operator, by reason of the ~any signs per~itted his, th~ a proprietor of some other type of busimess and that this additional advertising is u~eees~ax-y, unwarranted, unsaffe and prebibiti~e te the best interest of the Town of Seuthold. Fee Paid - No fee paid, this being a~ application for a variance to the Zoning Or~o-ce due to lack of access to property. Chairman opened the hear~-8 by reading application, letterto Mr. Gibson advising of date of public hearing and legal notice with affida.it attestS-8 to publication in the local newspaper. Chairman a~ked if there were anyone present who wished to speak for this appeal and Mr. Gibson and Mrs. Fisher of Southold replied that they were both in favor of the gr--ting of the variance. After review of the application and sketch of the property in question, Beard unanimously agreed to grant a 2~ foot access or right e/~way89, from Horton'e T..., Southold, N. Y., 82 feet east to lot described as 100' x 237.35'. Right ef way, as origiaally granted to Mr. Gibson ~- Deed to the property in question. I~BLVO HEARING~ Appeal Mo. 88 - Application of Smitro Adams,reich of ~27 Xaplan Avenue, C~eenp~rt, New York. Fee Paid - $15.00. Application for a variance under Article III, Section 307, of the Zoning Ordinance. Chairman read application, letter to applicant advising h~. of date ef public hearing and legal notice with affidavit attesting to publication in the local newspaper. There was no one present who wished to spe~__~ either for or ag~st the appeal and Board reviewed the applieatioa. Board u~ani~ously agreed to grant the variance to reduce the side yard requirement of the Oral!ns_nos by one fsot to per~it the proposed house to bo Built one fo~t further to the north on the property described as Lot ~62; Founders Path, SoUth, Id, New York. It was the detern~--tion of the Board that the hardship is undue and unique because of the elope of the property and the 50' lot is lest one for sale in a filed subdivision and the variance as gr~ted does observe the spirit ~f the Or~4---~e and would not cm~_.-~e the cho~actor of the neighborhood as cth-_- houses in the area have very narrow side yards and all sites · urroundfng the proposed site are ~O feet from property lime of lot in question.
