A regular leering of the Southold Tow~ Board of Appeals was held at the Town
Clerkt s Office, Southold, New York, on Thursday evening, Ootoher 9, 1958 at 8 P.M.
There were present= Messrs. Robert W. Gillispie, Jr., Chairman; Robert Bergen,
Herbert Rosanherg and Charles C~igonis, Jr.
Absent.. Mr. Serge Doyen, Jr.
Also present= Mr. Howard M. Terry, Building I~speotore
PUBLIC ~= Appeal No. 10~ - Application of Spt~e Zucb]tch, Hom~el Avenue,
Southold, New York, for a variance to the Zo-t-g Ordinance under Article III, Section
300, subsection 1, for per~it to use for two family dwelling the property located at
Seuthold, New York, b~unded on north by la~ of J. M. Ggatta~, on east by land of
Carl Butkovioh, on south by Hommel Avenue and on west by land of J. M. Grattan. Fee
Paid - $15.OO.
Cha~aan opened the hearing by read!~Z application, notice of disapproval issued
by the buil~izg inspector, and legal notice of hearing with affidavit attesting to
its publication in the official newspaper.
There was no one present who desire~ to speak either #for" or #against" the
appeal.
Oa ~otion duly ~ade by Mr. Grigonis, seconded by Mr. Bergen, and carried, it
was unaninously
RESOLVED, that the application of ~piro Zuchlioh, appeal No. 106 dated September
25, 1958, for permission to use his pwesent residence for two families, be granted.
The Board agrees with the applicant that undue hardship would be caused by failure
to grant this application because many of the houses in this block are now two family
houses. It also agrees that the hardship is unique because this is the last house in
the Block suitable for this oh~eover. It finds that granting of this application
would not eb~_~ge the character of the district because there are now five houses used

for two f-m~ly occupancy on this street and the applicant's house is now between
a pair of two f,m~ly houses.
The Board finds its authority for this action in Article VIII, ~ection 801-B,
concerning ,m~ecessary hardships in the way of carrying out the strict letter of
these regulations$

PUBLIC ~ARING: Appeal No. 105 - Application of Robert G. and Bertb_~_ S.
Rockefeller, 104-27 107th S~reet, Ozone Park 17, N. Y., for a variance in accord-
ance with the ~.O-t-g Ordi~_~_~ce~ Article III, Section 303, for permit to use the
prope~y located at Arsham~soque, New York, bounded on the north by Long Island
~ound, on the east by land of D. DriscoLl, on the south by North Road and on the
west by land of Charles Bu~t, for uses permitted under Article III in the #AW
Residential and Agricultural districts. Fee paid - $15.00.
The Chairman read the application, notice of disapproval by the building
inspector and legal notice of hearing with affidavit attesting to its publication
in the official newspaper.
There was no one present who wished to speak either "for" or Sagainst" the
appeal.
On motion made by Mr. Bergen, seconded by Mr. Grigonis,and carrie~l, the
following resolution was
RESOLVED. that the application of Robert G. Rockefeller and Bertha S.
Rockefeller, Appeal No. 105 d~.ted September 20, 1958, for a permit to use the
easterly half of the property,described in deed accompanying application, for
uses permitted in Article III, covering #A# Residential and Agricultural Districts,
Be granted.
The Board finds the reasoning of the applica~ to valid. Specifically, the
Board agrees with the applicant that strict application of the Ordinance would
produce undue hardship Because of the 1505 size of the present lot. It also
finds the hardship --~_qus because there are no other lots ~n the iaaa.dist, vicinity
with frontages as large as 100 feet. The character of the neighborhood will not
be affected _~ the lots resulting from this division will Be in excess of the
required 12,500 square feet.
Vote= Mr. Gillispie, aye; Mr. Rosenberg, aye; Mr. Grigonis, aye and Mr.
Bergen, ayes
PUBLIC ~T~ARING~ Appeal No. 104, Application of Guido Ciacia, R.F.D., Southold,
N.Y. for a special exception under the ~.oning Ordiam~ee, in accordance with Article
X, Section 1007, paragraph (e) for an addition to a no~-conforming business on the
property in Southold, N. Y.~ bounded on north by laud ~f ~. ~_-~ on east by a
proposed road (~awrence Lane), on south by Kerwin Blvd and on west by Main Road.

Chairman read the application, notice of disapproval by the building inspector
and legal notice of public hearing with affidavit attesting to its publication in
the official newspaper.
In response to the Chairmanls asking whether there was a-yon, present who
wished to speak "for" the application Mr. Ciacia presented a sketch of the plot
and the proposed addition to the building.
There was no one else present who wished to speak either 'fore or eagainstethe
appeal.
On motion made by Mr. Grigonis, seconded by Mr. Rossnberg, and carried, the
following resolution was offered:
P. ESOLV~D, that the special exception on application No. 104 dated September 19,
1958, of Guido Ciacia, requesting permission to enlarge his boat building and repair
shop from its present size of 24' x 36' to an enlarged size of 44' x 52', be granted,
subject to the following conditions:
1. Size of the enlarged building~ay not exceed dimensions noted; namely,
~' x 52'.
2. The side !~ue on Kerwin Blvd may not be closer to Ke~w~n Blvd than the
side line already established for the existing building.
3. The new side line on the north side of the building ~ay not be closer
than 9' to the lot of John Ciacia.
4. Completion of this work is to be accomplished within one year from this
date.
In considering this application the Board finds that it would be an undue
ha_r~ship to prevent the expansion of this business. It is believed that this
exception will not change essentially the character of the neighborhood and the Board
also notes th. fact that applicant owns a lot to the east and that property on the
south side of Kerwin Blvd is already zoned for business.
Vote: Mr. Rosenberg, aye; Mr. Gillispie, aye; Mr. Bergen, aye And Mr.
Grigonis, aye.
On motion made, seconded and unani~&usly carried it was

be held by the Zoning Board of Appeals of the Town of Seutheld:
Public hearing to be held at 7~30 P.M. (E.D.$.T.) at the Town Clerk's Office,
Main Street, Southold, New York, on October 23, 1958, upon application of Od.il
Smith for a variance due to lack of access, in accordance with State of New York
Town Law, Section 280A, Subsection 3.
Public Hearing to be held at 7~45 P.M. (E.D.$.T.) at the Town Clerk's Office,
Main Street, Southold, New York, on October 23, 1958, upon application of Oharles
Abre~__~s and wife for a variance, in accordance with the Zoning Ordinance, Article
III, Section 300, subsection 1, and Sections 303, 304, 306 and 308 for permit to use

The minutes of the meeting of October 2, 1958 were read. On motion made by
Mr. Grigonis, seconded by Mre Rosenberg, and carried, minutes were approved as
submitted.
The next meeting of the Board is scheduled for Thursday, October 23, 1958 at
7830 P.M. in the Town Clerk's Office, Southold, N. Ye
