T~[ephone SO 5-2660 ~INUTES Southold Town Board of Appeals $ctoher 23, 1958 A regular meeting of the Southold Town Board of Appeals was held at the Town Clerk's Office, Southold, New York, on Thursday, October 23, 1958, at 7:30 P.M. There were present: Messrs. Robert W. Gillispie, Jr., Chairm-~; Robert Bergen, Herbert Rosenberg and Charles Grigonis, Jr. Absent: Mr. Serge D~yen, Jr. Also present: Mr. H~ward M. Terry, Building Inspector. PUBLIC Pr~.ARING; Appeal No. 108 - Application of Odell Smith of 404 West St., Green~ort, New York, for a variance due to lack of access, under provisions of Section 280A of the Town Law. No fee paid. Chairman opened the hearing by reading application for the variance, notice of disapproval issued to applicant by the Building Inspector and legal notice of hearing with affidavit attesting to its publication in the official newspaper. There was no one present who wished to speak either for or against the appeal. On motion made by Mr. Rosenberg, seconded by Mr. Bergen, and carried, it was unanimously RESOLVED, That a right of access be granted from 7th or Se_~nd Streets to Lot No. 77, as shown on map No. 369 of Greenport Driving Park, on Flint Street Extension, Greenport, New York. In granting this right of access the board feels that strict application of the Ordinance would produce undue and unique hardship since Flint Street Extension was ~aid out and dedicated to the Town many years ago, although the Town has not maintained the street and is unable tc take over the street under present rules and regulations. Board feels that the variance does observe the spirit of the Ordinance and would not change the character of the district as this means of access has been used for .~r~V years by neighboring residents. -2- Southold Town Board of Appea~s October 23, 19~8 M~S, Oontinued Vote of the Board: Ayes - Mr. Gillispie, Mr. Roseuberg, ~.
