THIS INDENTURE, made the 5th day of October nineteen hundred and seventy-three,
BETWEEN DIEL E. EGGERS, residing at North Cross Road (no street
number), Cutchogue, New York, as surviving tenant by the entirety,
C. party of the first part, and JENNIE PAWLUCZYK, residing at Main Road (no street

WITNESSETH,that the party of the firstpart,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the putt' of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereoa erected, situate,
lying and being at Cutchogue, Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a point on the northerly side of North Cross Road
which point is marked by a monument which is distant 150 feet
easterly from the corner formed by the intersection of the easterly
side of West Creek Avenue and the northerly side of North Cross Road,
which beginning point is also the point where the easterly line of
land of Seltzer (formerly Fagan) intersects said northerly side of
North Cross Road; running thence along said land of Seltzer North
3 degrees 56 minutes 20 seconds West 220 feet to a monument and
land of Beebe; running thence along said land of Beebe, North 63
degrees 10 minutes 30 seconds East 55. 38 feet to a monument and
other land of Seltzer (formerly Fleet Estate) ; thence along said
land South 21 degrees 00 minutes 20 seconds East 252. 66 feetto a
monument on the northerly side of North Cross Road; thence along
said northerly side of North Cross Road, South 86 degrees 03 minutes
40 seconds West 125. 15 feet to the point or place of BEGINNING.
SUBJECT to covenants, restrictions, reservations and agreements
as set forth in Liber 4637, page 550.

TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE A
ND To
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of t
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of payingthe cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the name for
any other purpose.
The word "party" shall be construed as i`' it read "parties" whenever the sense of this indenture so requires.
