THIS INDENTURE, made theday of March nineteen hundred and seventy-three,

party of the first part, and GEORGE L. PENNY III, residing at New Suffolk Avenue
(no street number), Mattituck, Suffolk County, New York,
party of the second part,

BEGINNING at a point on the southeasterly side of a ' 33 foot right-
of-way at a point 390 feet southwesterly along said right-of-way
from a monument marking the boundary line of property of the Estate
of Alice H. W. Boutcher; from said point of beginning running thence
along land of Mil'owski, South 57 degrees 51 minutes 40 seconds East
185.41 feet to land of the Boutcher Estate; running thence South
48 degrees 00 minutes West along said Boutcher Estate 100 feet to
other land of the party of the first part; running thence North
57 degrees 51 minutes 40 seconds West 185.41 feet to the southeast-
L^ erly line of said right-of-way; running thence North 48 degrees
00 minutes East 100 feet along the southerly side of said right-of-
way to the point or place of BEGINNING.

TOGETHER with all right,title and interest,if any, of the party of the first part of, in and to any strata and
roads abutting the above-described premises to the center lines thereof; TOGETHER With the appurtenances
and all the estate and rights of the party of the first part in and to said preatsee, CO HAVX AND TO
HOLD the premises herein granted unto the party of the second part, theah 'n or arn:cnson and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lica Law, cowmants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the tmptov®mt and will apply
the same first to the payment of the cost of the improvement before using any part of Cie total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
