Clerk~.s O~fice, Southold~ New York~ on Thursday, November I~ 1958, at 7,:30 P.M.
There were present= Messrs. Robert W. Gillispie, Jr., Chairman, Robert Bergen,
Herbert Rosenberg and Charles Grigonis, Jr., and Serge Doyen, Jr.
Also present= Mr, H~war~ Me Terry, BuAlding Inspector.
PI~BLIO HEARING: Appeal No. 110 - Application of Henry O. Kruger of
Oak Street, Outchogue~ New York, for a variance in accordance with the Zoning
Ordinance, Article III, Section 304, for permit to build an addition to premises
on Lots 30 and 31 on map of Eugene Heights, east side of Oak Street, Outchogue~ N.Y.,
Fee Paid-S15.00.
Chairman opened the hearing by reading application for the variance, notice
of disapproval issued to applicant by the Building Inspector and legal notice of
hearing with affidavit attesting to its publication in the official newspaper.

Mr. Kruger: "I don't have anything further to say than what is on the
application; except that because of the placement of the house there was no other
place for a garage.
Mr. Terry Showed the map and explained.
Chairman: "How close is it to the house so far as we are concrened?"
"4' 10" from the property ."

On motion made by Mr. Rosenberg, seconded by Mr. Doyen, and carried, it was
unanimously resolv
RESOLVED, that the application of Henry O. Kruger for a variance to build an
addition to his premises on Lots 30 and 31 on map of Eugene Heights, east side of
Oak Street, Cutchogue, New York, be granted. The applicant is to build no closer
than four feet eight inches from the property line o~ Oak Streete
Vote of the Board: Ayes - Mr. Gillespie, Mr. Rosenberg, Mr. Grigonis, Mr. Bergen,
and Mw. Doyen.
PUBLIC HEARING: Appeal No. 109- Application of Jo Richard Holmes, of Mill
Road, Mattituek, N.Y., for a special exception in accordance with the Zoning Ordinance,
Article III, Section 300, Subsection 11 to erect and maintain an advertising directional
sign on land of Pylko at Route 27A and Cox Neck Road, Mattituck, New York, Fee Paid $15.00

with affidavit attesting to its publication in the official newspaper.
There was no one present who wished to speak either for or against the appeal.
Mr. Bergen: "He stated that he had permission to erect his sign. Did he
have written permission?"
Chair=~: "I think we talked to him about getting permission from Mrs. Pylko

that she was willin$ to let him erect a sign on her property."
Mr. Terry: "I have received no letter whatsoever."
ChaJ_,~aan: "I think this application should be continued until Mr. Terry
can be in touch with Mr. Holmes." "What is the opinion of the Board with regard to
what he proposes to put on this sign?"
After a brief discussion, the Board decided that this sort of sign should be
confined to the bare minimum necessary to inform the public. In other words, "Old Mill
In, Restaurant - Bar ".
Hearing continued until written permission is obtained.
PUBLIC HEARING: - Appeal No. 116 - Application of Victor Trunce of Bay View Road,
~outhol$ New York, for a variance in accordance with the Zoning Ordinance, Article III,
Section 300, Subsection 1 for permit to use for a two family dwelling on premises
located at Southold, N.Y., bounded on north by land of Ulleriok on east ~y ~
of Zazecki, on the south by land of Smith and on the west by Bay Vie~Road.
Fee Paid - $15.00.
Chairman read the application for the variance, notice of disapproval issued to
applicant by the Building Inspector and legal notice of hearing with affidavit
attesting to its publication i~ the official newspaper.
Chairman: "Is there anyone present who wishes to speak for this application?"
Mrs. Trance: "I have nothing to add to the application." Mrs. Trance stated that
there would be no exterior alterationee
There was no one present who wished to speak against this application.
Chairman: "I believe from what I h~ve been told and know of this property,
that we could consider this under Section ~8Q1B.
On motion made by Mr. Grigonis, seco~edby Mr. Doyen, and carried, it was
u-~nimously
RESOLVED, that this application be granted. The condition of granting this
application is that the residence be used for no more than two (2)families. A
further condition is that there be no exterior additions or alterations in converting
this residence.
Vote of the Board: -Ayes - Mr. Gillespie, Mr. Rosenberg, Mr. Grigonis, Mr. Bergen and
Mr. Doyen.

PUBLIC HEARING - Appeal No. 117 of William H. Sorenson, Orient, N.Y. for a
variance in accordance with the Zoning Ordinance, Article III, Section 300, Subsection 1
and Section 304 for permit to use an existing ~on-conforming two family dwelling
for three apartments. This property located on the east side of Village Lane and the
South side of Navy Street, Orient, N.Y. and bounded by land of Harris on the south.
Fee paid $15.00.
Chairman read the application for a variance, notice of disapproval issued
applicant by the Building Inspector and legal notice of hearing with a~fAdavit
attesting to its publication in the official newspaper.
Chairman: "Is there anyone here who wishes to speak for this application?"
Mr. Serenson stated that he had nothing to add and stated that the house needed
modernization badly.
Chairman: "Is there anyone here who wishes to speak against this application"?
Mr. Terry: "It wmm investigated by the investigating committee. The committee
contacted people in the area who had no objections but did not wish the zoning to
be changed, and therefore, the investigating committee turned in a~mea-l-r .r~p~rt
on the change." ~'~'~]~~ ~
Chairman: "It would be my opinion from what I can learn from the situation,
that this would be an improvement both for the applicant and for the neighborhood."
On motion made by Mr, Bergen, seconded by Mr. Doyen, it was unanimously
RESOLV~_~ that a variance be granted to use a two family dwelling for three
apartments. The condition of the application is that the residence be limited to
use by three families.
Vote of the Board. Ayes - Mr. Gilli~e, Mr. Rosenberg, Mr. Gr~gonis, Mr. Bergen
and Nrc Doyen.
Minutes of the previous meeting held on October 23, 1958 were on motion made
by Mr. Gr&gonis and seconded by Mro Bergen, and carried, it was
RESOLVED that the minutes of thm October 23, 1958 meeting be approved as submitted.
PUBLIG HEARING - Appeal No. 112 Eva M. Main, 100 Circle Drive, Plandome Manor, N.Y.
for a variance in accordance with the Zoning Ordinance Article IV Section 400 Subsection 1
and Section 307 for permit to use and build on property located on Sound View Avenue
and Goldin Lane, known as Lot 8 on map of Nathan Goldin, Southold, N.Y.
Chair,mn read the application for a variance, and legal notice of hearing with
affidavit attesting to its publication in the official newspaper.
The map was examined by the Board.
Chairman: "Is there anyone who wishes to speak for this application?"
Mr. William Wickham sp~ke for Mrs. Eva M. Main, and stated that the lots were
to be combined and that ~¥s. Main desired to build four more income producing
cottages.

~. Wickhamalso stated thatMrs. Main was purchasing Lot No. 4, but was
reserving it for access to the Sound.
On motion made by Mr. Rosanberg, seconded by Mr. Gregonis, and carried, it was
unanimously
RESOLVED, that the application be ~ranted provided the location of the house
to be constructed on Lot No. 8 conforms to the prevailing setback established by the
residence on Lot No. ? so far as distance from Sound View Avenue is concerned. It
is the further condition of this decision that the residence shall not be closer to
Goldin Lane than the prevailing front yard line established by the residences on
Lots 10 and 12o It is the interpretation of the Board that Sound View Avenue is the
front of the property.

N.Y., for a variance in accordance with the Zoning Ordinance, Article IV, Section
400, Subsection 1, for permit to use and build on property located on south side
Sound View Avenue, known as Lot 9 on map of Nathan Goldin, Southold, N.Y.
Chairman read the application for a variance, and legal notice of hearing with

Mr. Wickham stated that he had nothing further to add than previously

On motion made by Mr. Bergen, seconded by Mr. Doyen, it was unanimously
P~SOLVED that a variance be granted with the condition that the residence to be
constructed on Lot no. 9 shall conform so far as front yard restrictions are concerned,
to the setback established by the residence on Lot No. 6 of this map.
Vote of the Board.-Ayes, Mr. Gillispie, ~. Rosenberg, ~. Gregonis, Mr. Bergen
and Mr. Doyen.

N.Y., for a variance in accordance with the Zoning Ordinance, Article IV, Section 400
Subsection 1, for permit to use and bu~ on property locate~ on east side of Goldin
Lane known as Lot 11 on map of Nathan Goldln, Southold, N.Y.
Chairman read the application for a variance, and legal notice of hearing with
affidavit attesting to its publication in the official newspaper.

PUBLIC ~FARING: Appeal No. 115, Eva M. Main, 100 Circle Drive, Plandome Manor,
N.Y., for a variance in accordance with the F. oning Ordinance, Article IV, Section 400,
Subsection 1 and Section 306 for permit to use and build on property located on North
Road and Goldin Lane, known as the southerly part of Lots 13 and 14 on map of Nathan
Goldin, Southold, N.Y.
No one wished to speak for or against the application
On motion by Mr. Rosenberg, seconded by Mm. Gregonis, and carried, it was
unanimously
RESOLVED that the application be granted on condition that it shall conform
to the setback established by the residences already constructed on Lots 10 and 12.
No part of this residence shall be closer than 20 feet to the North Road.
PUBLIC HEARING, Appeal No. 94, NellaWilliams, East ~rion, N.Y., for a variance
of the Zoning Ordinance, A~ticle III, Section 303, 30~, 307, 308, and recognition of
access, Section 280-a~ on property located on the south side of the Main Road, on
private Road, East Marion, N.Y.
Chairman asked if there was anyone who wished to speak for the appeal~
Mr. Corwin, speaking for Mrs. Wil~ms, stated that he wished to amend his
previous application by eliminating paragraphs I and II, and not appealing for
a multiple variance. He stated that he wished for a variance for the westerly
portion of Lot no. l~and also access.
On motion made by Mr. Rosenberg, seconded by Mr. Gregonis, and carried, it was
unanimously
RESOLVED that the application be granted for a permit to use for residential
purposes the westerly portion of Lot 14 on the original map as described in the
application and including part of the original southerly portion of lot no. 15,
to be sold to A. Griebe from map drawn August 25, 1958, by Otto W. Van Tuyl, and
also the right of way to lot no. 14 as described on the same map is also approved
for access. The condition of granting this application is that there be no
construction closer than eight (8) feet to the easterly line of the property
described in the application.
Vote of the Board: Ayes, Mr. GillAspie, Mr. Rosenberg, Mr. Gregonis, Mr. Bergen
and Mr, Doyen.

Minutes of meeting at Fishers Island on November 5, 1958 were amended
Bublic hearings to be held at the Southold Town Clerk's office, Main Road, Southold, N.Y.,
on November 20, 1958, on the following:
7:30 P~.~. upon application of G.W. Smith & Sons, for Arthur Cornell for a special
exception in accordance with the Zoning Ordinance Article III, Section 306, for
permit to use and build an attached garage on property located on the west side
of Oakwood Drive, Oakwoo6 Park, Southold, N.Y.
7:40 P.M. upon application of ~ames Schwartz & Co., Inc. for Paul Ellenberger, for
a variance in accordance with the Zoning Ordinance, Article III, Section 307, for
permit to use amd build an attached garage on property located on Lot 376, Haywaters
Road, Cutchogue, N.Y.
