Telephone SO 5-2660 MINUTES Southold Town Board of appeals November 20, 1958 A regular meeting of the Southold Town Board of Appeals was held at the Tow~ Clerk's Office, Southold, New York, on Thursday, November 20, 1958, at 7:30 P.M. There were ~resent: Messrs. Robert W. Gillispie, Jr., Chairman, Robert Bergen, Herbert Rosenberg and Charles Gregonis, Jr. Also present: Mr. Howard M. Terry, Building Inspector. PUBLIC HEARING: Appeal No. 119, Application of G. W. Smith & Sons, for Arthur Cornell~ for a special exception in accordance with the Zoning Ordinance, Article III, ~ection 306, for permit to use and build an attached garage on property located on the west side of Oak~ Drive, Oakwood Park, Southold, N.Y. Fee paid - $15.00. Chairman opened the hearing by reading application for the variance, notice of disapproval issued to applicant by the Building Inspector and legal notice of hearing with affidavit attesting to its publication in the official newspaper. No one wished tc speak for or against the application. Resolution offered by Mr. Gregonis, and seconded by Mr. Bergen, Whereas the application of G. W. Smith & Sons, for Arthur Cornell, requesting a special exception for permit to use and b~]d an attached garage on property located on the west side of Oakwood Drive, Oakwood Park, Southold, N.Y., having bee~ considered at Public Hearing No. 119, on November 20, 1958, and the Board finding that strict application of the Ordinance would produce undue hardship because the adjoining property has been sold and it is impossible to e-l~ge lot. The situation is unique because itl a new area and all the other lots meet the Zoning requirements. The public convenience and welfare and Justice will be substantially served, and the legally established or permitted use of districts would not be substantially or permanently injured and the spirit of the ordinance wo,_,!~ be observed. Be it resolved that the application be granted subject to the following conditions Southo~ Town Board of Appeals -2- November 20, 1958 and safeguard,; attached garage to be built no closer than 23 feet on Ohristopher Street~ Vote of Board: Ayes - Mr. Gillispie, Mr. Rosenberg, Mr. Grigonis, and Mx. Bergen. PUBLIC HEARING: Appeal No.120, upon application of Ja~es Schwartz & Co., Inc. for Paul Ellenberger, for a variance in accordance with the Zoning Ordinance, Article III, Section 307, for per,it to use and build an attached garage on property located on Lot 376, Haywaters Road, Cutc hogue, N.Y. Chairman read the application f~r a variance. Chairman: "Is there anyone who wishes to speak for this application?" Mr. Ellenber stated that he had intended to build a garage at first and then decided to build an attached breezeway, and that left only five feet on the side instead of the required ten. It was determined that there would be a total of 30 feet side yard. There was no one who wished to speak against the application. Resolution offered by Mr. Gregonis, and seconded by Mr. Bergen, Whereas the application of James Schwartz & 0o., Inc., for Paul Ellenberger, having been considered at Public Hearing No. 120, on November 20, 1958, and the Board finding that strict application of the Ordinance would produce undue bm~dship because cement foundation for the garage was laid and then a breezeway was desired. The situation is unique . The public convenience and welfare and justice wi~_l be substantially served, and the legally established or permitted use of neighborhood property and adjacent use districts would not be substantially or permanently injured and the spirit of the ordinance would be observed. Be it resolved that the application be granted subject to the following conditions and safeguards~ application for a reduced side yard on the south side of the lot described is granted on condition that the garage is to be no closer than five feet to the south side line. Vote of Board: Ayes- ~ro Gillispie, Mr. Rosenberg, Mr. Gregonis and Mro Bergen. By Resolution offered by Mr. Bergen, seconded by Mr° Bergen, minutes of the previous meeting held November 6, 1958, be app~roved as corrected. The Board examined and discussed a preliminary plan of lots at Sandy Beach, near Greenport, New York, made for Robert Preston~ dated October ~, 1958. By Resolution offered by Mr. Gregonis, seconded by Mr. Bergen, time and place of next meeting was fixed° Meeting tc be held at the Southold Town Clerk's Office on ~ecember 4, 1958, at 7:30 P.M. 7~30P.M.(E.S.T.) upon application of Alexander Blaschak, New~uffolk Lane, Cutchcgue, N.Y., for a variance in accordance with the Zoning Ordinance Article IV, Section 400, for permit to use for residential purposes property located on the east side of New Suffolk Lane, ~utchogue, N.Y. Southold Town Board of A~peals -3- November 20, 1958 (legal notices for December 4, 1958 meeting) 7:45 PMo (E.S.T.) upon application of Gillman Hallenback, of 44 Meadowbrook Road, Lake Success, N.Y., for right of access, in accordance with the Zoning Ordimance, ~ection 280a, S~bsection 3, on property located on a private road, boun~ed north by land of Robinson, east by Peconic Bay, south by Soalia and west by private road, Paradise Point, Southold, N.Y.
