WARD, also known as JOHN T. WARD, and MATILDA G. 3 WARD, his wife, both residing at 265 Maple Street, Islip, New York, party of the first part, and JOHN J. KANE and AGNES J. KANE, his wife, both residing at Pequash Avenue (no street number), Cutchogue, New York, party of the second part, o "Ir-14 WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration MI\ M paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs ,t or successors and assigns of the party of the second part forever, rr 3 ALL that certain plot, pieee or parcel of land, with the buildings and improvements thereon erected, situate, X lying and being in the Town of Southold, County of Suffolk and State of h° New York, at Fleet' s Neck, near Cutchogue, bounded and described as follows: BEGINNING 'at a concrete monument set -on thewesterly line of Fleet' s LL Neck Road at the northeasterly corner of land of Kane (party of the second part) ; THENCE from said point of beginning running,,along the westerly lineof Fleet' s Neck Road, North 45 degrees 29 uYil > s West _ - 50. 0 feet to a point; THENCE running the following two (2)ec�ourses and distances ; (1) South 44 degrees 31 minutes West 150. 0 feet to lands i or formerly to George H. Fleet; (2) South 45 degrees 29 minutes West 50. 0 feet to lands of Kane (party of the second part) ; THENCE along said last mentioned lands North 44 degrees 31 minutes East 150.0 feet to the westerly side of Fleet' s Neck Road and the monument at the point or place of beginning. SUBJECT to covenants and restrictions contained in deed recorded in Liber 4743, page 520. BEING AND INTENDED TO BE a part of the same premises conveyed by deed .dated November 9, 1967, and recorded in the Office of the Clerk of the County of Suffolk on November 20, 1967, in Liber 6259, page 33. TOGETHER with all right,title and interest, if any, of the party of the first part of, in and to any streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with the and all the estate and rights of the party of the first part in and to said premises; TO HAVAND To HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first tart will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of,the improvement before using any part of the total of the tame for any other purpose. The word"party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
