Being the same premises conveyed to the grantor herein by
deed dated the 9th day of February, 1940 and recorded in
Liber 4163 Page 120 .
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land with the buildings
and improvements thereon erected, situated, lying and being in
the Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
COMMENCING at the southeast corner of the parcel hereby conveyed,
at a point in the boundary line between lands of Helen G. Cochran
and lands now or formerly of Mills , and which point is
distant34.86 feet on a course South 30 degrees 23 minutes 40
seconds West from the intersection of the southerly line of Main
Bayview Road with the westerly line of land of Mills and the
easterly line of lands conveyed to Helen G. Cochran by Howard M.
Terry and others in March 1956;
RUNNING THENCE North 30 degrees 23 minutes 40 seconds East along
land of Retzler ( formerly of Mills ) a distance of 163. 58 feet to
a point;
THENCE RUNNING North 55 degrees 02 minutes 40 seconds West a
distance of 93.70 feet to a point;
THENCE RUNNING at right angles to the northerly line hereof a
distancce of 168 . 93 feet to a point;
THENCE RUNNING easterly on a curve to the right along the
northerly line of a private roadway a distance of 107. 27 feet to
the pointor place of BEGINNING.
TOGETHER with a right if way for ingress and egress and for
public utilities, in common with others, over a strip of land
fifty feet wide extending from the southeasterly corner of said
premises to Main Bay View Road, said strip of land to be in such
location as reasonably designated by Helen G. Cochran. Said
right if way shall be contiguous to and touch on all points in
the southerly line of the premises above conveyed.
SAID premises are known as lot # 18 on Map of Terry Waters at Bay
View, Town of Southold, Suffolk County, New York, which map is
filed in Suffolk County Clerk ' s Office on December 29, 1958 as
Map no. 2901 .

The premisess are sold subject to the provisions of a declaration
recorded by Helen G. Cochran on September 8, 1958 in Suffolk
County Clerk ' s Office in Liber 4508 Cp 380.
TOGEITHER with a right to use in common with others, and only for
the benefit of the premises herein conveyed, for bathing and
recreation of a parcel of land bounded and described as follows:
COMMENCING at the northwest corner thereof, at a point in the
southerly side of Watersedge Way ( a private roadway on premises
of Helen G. Cochran) , that is distant the following two courses
and distances from a monument set at the intersection of the
southerly line of Main Bayview Road with the easterly line of
William Wells;
( 1 ) South 38 degrees 06 minutes 30 seconds West 1800.43 feet
to a point;
( 2) South 66 degrees 22 minutes 10 seconds East 680. feet
to the point of beginning;
RUNNING THENCE South 66 degrees 22 minutes 10 seconds East along
the southelry side of Watersedge Way 59 .02 feet;
THENCE RUNNING still along Watersedge Way and Rambler Raod, on a
curve to the left having a radius of 70 feet a distance of 103 .09
feet;
THENCE RUNNING North 29 degrees 15 minutes East along the
easterly line of Rambler Road a distance of 39 . 31 feet;
THENCE RUNNING South 60 degrees 45 minutes East along other lands
of Helen G. Cochran a distance of 135 feet to a point;
THENCE RUNNING South 28 degrees 52 minutes 20 seconds West a
distance of 300 feet more or less to ordinary high water mark of
Peconic Bay;
THENCE RUNNING northwesterly along ordinary high water mark of
Peconic Bay a distance of about 240 feet to a oint in a line that
runs South 23 degrees 37 minutes 50 seconds West a distance of
about 210 feet from the point of beginning;
RUNNING THENCE North 23 degrees 37 minutes 50 seconds East a
distance of 210 feet more or less to the point or place of
BEGINNING.
TOGETHER with a right of way for ingress and egress in common
with others, and only for the benefit of the premises above
described over a 50-foot strip of land extending from the
recreation area above described to Main Bayview Road; said strip
of land to be in such location as reasonably designated by Helen
G. Cochran.
