the remises conveyed to the partie:l
of the first part by deed dated July 17 , 1958 and recorded in the
Suffolk County Clerk's Office on July 25, 1958 in Liber 4490 Page 588 . .
The conveyance hereunder is subject to a certain mortgage execu-
ted by William Topping and Dorothy Topping as mortgagors to Riverhead
Savings Bank as mortgagee, which mortgage is dated November 28, 1958
and recorded on December 9, 1958 in the Office of the Clerk of the
County of Suffolk, in liber 3130 of mortgages, at page 253, which
c. mortgage was consolidated with a mortgage executed by William Topping
and Dorothy Topping as mortgagors to Riverhead Savings Bank as mortga-
gee, which mortgage is dated` February 18 , 1965 and recorded on March
1, 1965 in the Office of the Clerk of the County of Suffolk, in liber
4597 of mortgages, at page 530 and on which mortgages there is now
due the sum of $10 ,925. 80 with interest thereon at the rate of
(5 1/2) percent per annum from February 1, 1978 and that the grantee
" hereby assumes and covenants to pay such mortgage debt and interest
as part of the consideration for this conveyance.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will bold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose
