testamentary were issued by the Surrogate's Court, Suffolk County, New York
on October 5, 1977 and by virtue of the power and authority given in and by said last will
and testament, and/or by Article I I of the Estates, Powers and Trusts Law, and in consideration of

release unto the party of the second part, the distributees or successors and assigns of the party of the second
part forever,

feet to a stake set in the northwesterly line of Olejulane; thence
North 56° 27' 10" East 209.88 feet along the northwesterly line of
Olejulane to the point or place of BEGINNING.
IT IS EXPRESSLY AGREED AND UNDERSTOOD that the party of the first part,
is heirs or assigns, is not committed or required to construct the
said proposed private road known as "Nuart Lane" ; if such a private
road is constructed adjoining the premises of the party of the second
part, said party of the second part is hereby given a right of way over
said private road but nothing else.
TOGETHER WITH all the right, title and interest of the party of the
first part,- if any, in and to Olejulane in front of and adjacent to

TOGETHER WITH the right of way, if any, over a certain 25 feet private
road leading from the southerly line of New Suffolk Avenue southerly
to Peconic Bay.
