LENAHAN, his wife, both residing on Marlene Lane, Mattituck, County of Suffolk and State of New York part of the first art, and SOFIA BARUCCO, his wife, ANTONIO BARUCCO, residing at 17 Sherman Avenue, Rockville Centre, County of Nassau and State of New York 3 - 3� party of the second part, t E WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable con- sideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, r.� ALL that certain plot, piece or parcel of land, with the buildings and improvements [hereon erected, situ- ate, 13•in and being in the at Mattituck, 'Town of Southold, County Of SuffOlk x and State of New York, bounded and described as 'follows: ~ BEGINNING at a concrete monument set on the northwesterly Corner ' -m of the premises adjoining Kuck on the West and Gaffney on the North; Vw RUNNING THENCE North 700 05' East 150 feet to land of the v party of the first part; RUNNING THENCE in a southeasterly direction along other land of the party of the first part to the southerly line of said other land of the party of the first part; t RUNNING THENCE South 680 08 /50" West along lots 4, 3, 2 and 1 on "Map of Property of Alida Bartley", Suffolk County, File No. 770, 153 feet to a monument, and land of Kuck; RUNNING THENCE along said land of Kuck, North 190 09' 2011 West 95.94 feet to a monument and place of BEGINNING. TOGETHER with a right of way 12 feet in width running from the southeasterly corner of said premises along the southerly line of land of the party of the first part to Bay Avenue for access between said premises and Bay Avenue and for the installation of utility lines and mains. It is agreed, however, that the maintenance of said right of way shall be shared equally between the parties hereto. SUBJECT to any state of facts an accurate survey may show. SUBJECT to covenants, restrictions, reservations and easements of record. TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and roads abutting the above-described premises to the center lines thereof: TOGETHER with the appur- tenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any wav whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such con- sideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the pa%tnent of the cost of the improvement before using any part of the total of the same for an} other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
