Instructions
A. This application must be filled in typewriter OR ink, and submitted ~ to the Building Inspec-
torwith the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual

2. Final approval of Health Dept. of water supply and sewerage disposal-(S-9 form or equal.
~3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, acertificate of Code compliance from the Architect or Engineer responsible for the building.
5. Sub,~~it Planning Board approval of completed site plan requirements where applicable.

We have received another complaint regarding the upstairs
apartment-and construction work that was done in conjunction
with same.
After further investigation of the complaint we can find no
record of any building permits having been issued or any other
records statiztg that it is a legal apartment. It is the
opinion of the Town Attorney that you must furnish doctmtentation

Dear Bruce:
As we discussed the other day, I am of the opinion
that the application for a "use variance" is incorrect. A
use variance is requested when the use that a landowner
seeks to utilize is not a use which is allowed under a
zoning code. In this case the use requested is for a
two family house. This requested use is under Section
100-81B of the Code, and is considered a special exception.
As a special exception, the requested use must conform to
Article XXVI.
The issue, of course, is that while the code
allows a two family dwelling, it does not allow a "store
and a two family dwelling". A "st:ore" is allowed and
a two family dwelli-ng i_s allowed but are all three allowed _
in one structure, which structure is on-conormtn .
This matter was to be heard on November 29, 1990,
but at the request of the applicant it was adjourned.
1 called the ZBA and was advised that the matter was
adjourned wii;hout a date.
7 suggest we wait two weeks, and if no activity
on the application, that we speak to the Town Attorney's
Office and the Building Department.

To Whom It May Concern:
We (Elaine and Mark McDuffee) rented the premises at 37070 Main Road, Cutchogue, N. Y. and started
the Down Home Store there, in space formerly called The Gift Loft. We rented that space from February
1992 until February 1998.
The store is attached to a two story house at 55 Skunk lane, Cutchogue. Rayne Byer told us that the
upstairs apartment could not be used, that the kitchen had been removed. The space was unoccupied
during our entire time there and we understood that it could not be rented.
