H . Wells Estate; THENCE North 30 ` 14 ' 30" East along last mentioned land 160 . 00 feet to the Southerly side of Wells Road; THENCE Easterly along the Southerly side of Wells Road the following 2 courses and distances : 1 ) South 59' 45 ' 30" East 132 . 87 feet to a point of curve; 2 ) Along the arc of a curve bearing to the left having a radius of 256 feet a distance of 97 . 13 feet to the point or place of beginning . The parties of the first part herein are the same as the grantees in deed dated August 20 , 1993 and recorded in Liber 11642 Cp 438 . TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the TAX MAP premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the DESIGNATION second part forever. SUBJECT TO: The provisions of the Declaration , y-Laws , site plan and floor plans of the Condominium recorded r filed simultaneously with and as part of the Declaration , as the same may be amended from time to time by instruments recorded or filed in the Office of the Clerk of the County of Suffolk, which provisions , together with any amendments thereto shall bind any person having at any time any interest or estate in the unit , as though such provisions were recited at length herein. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part , the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid . AND the party of the first part, in compliance with Sec- tion 13 of the Lien Law , covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the impro- vement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purposes .
