LIBER 7489 PACE 524 THIS INDENTURE,made the 7th day of September , nineteen hundred and Seventy—three BETWEEN JOHN A. CLARKE, residing at 89 Five Mile River Road, Darien, f Connecticut, ' Ole party of the first part, and BARBARA B. CLARKE, residing at 89 Five Mile River Road, Darien, Connecticut, is party of the second part, WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, �( lying andbeingAKIhe at Nassau Point in Cutchogue , Town of Southold, County of Suffolk and State. -of New York, more particularly bounded and described- as follows : S BEGINNING at a point in the northerly side of the premises about to be described where the same is intersected by the division line ' between the easterly side of Vanston Road and the westerly line o,f, lot 250 as shown on a certain map entitled, "Amended Map A of Nassau Point" j and filed in the Office of the Clerk of the County of Suffolk as M p -, X156; running thence from said point or place of beginning the following courses and distances: (1) Along the southerly terminus of Vanston Road, South 801 4030" West, 25 feet ; (2) South 21° 54' 00" East, 97.74 feet; (3) North 800 40' 30" East, 262.41 feet; and (4) North 80° 40' 30." East, 25.59 feet, more or less, to the bulkhead at the high water mark of Wun- neweta Pond; running thence northerly, northwesterly and northerly along said bulkhead and along the ordinary high water mark of Wunneweta. Pond, to a point on the southerly side of lot 250 first above referred to, which point is distant 95.56 feet; when measured on a bearing of North 12° 44' 20" West from the Easterly terminus of the aforementioned course (3) ; running thence along said southerly side of lot 250 on said map, South 800 40' 30" West, 253.0 feet to the easterly side of Vanston Road, at the point or place of beginning. TOGETHER with an easement five foot in width running along the southerly line of land this day conveyed to Constance D. Moore by deed dated August 20, 1973 from JOHN A. CLARKE, CONSTANCE D. MOORE, JOAN DARBY MUNKENBECK and ELIZABETH C. HOHNHORST for access to Peconic Bay. SUBJECT to the use of the circular drive along the westerly portion of said premises for use by property of Ferend to the South. TOGETH ER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO IIOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
