paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs

to said map, as follows:
,I BEGINNING at a point on the Southeasterly side of Oak Street, distant 168 feet
j� Northeasterly from the point formed by the intersection of the Southeasterly side
of Oak Street and the Northeasterly side of Harbor Lane, from said part of
beginning; running along the Southeasterly side of Oak Street North 43 degrees
8 minutes 30 seconds East 23. 04 feet; thence along the division line between
Lots EIGHT (8) and NINE (9) South 72 degrees 31 minutes 30 seconds East 255 feet
to high water mark of Eugene's Creek; thence along said'high water mark of

Eugene's Creek to the division line between Lots SEVEN (7) and EIGHT (8); and
thence along said division line between Lots SEVEN (7) and EIGHT (8) North 66
!i degrees 50 minutes West 240 feet, to the point or place of BEGINNING, including
all riparian rights and strips and gores, if any.
Being the same premises as heretofore conveyed by deed dated August 8, 1962, and
recorded in the Office of the Clerk of the County of Suffolk on August 16, 1962, in
Liber 5215 at page 36.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
I; the party of the second part forever.

�i AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
i eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
ii any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
