WiTNFSSETH,that the party of the fiat part,in consideration of Ten Dollars and other valuable considerafioa
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, at Fleet's Neck, County of Suffolk and State of
New York, known and designated as Int 31 as shown on a certain rep entitled "Map of
Eastwood Estates, Section Two, situate at Fleet's Neck, Tuan of Southold, Suffolk
Canty, N.Y." made by Otto W. Van Tuyl & Son, Licensed land Surveyors, owned and
developed by the Estate of George H. Fleet, Cutchogue, N.Y., and filed in the office
of the Clerk of the County of Suffolk on November 30, 1964 as Map No. 4210.
SUBJECT to the following covenants and restrictions:
-- ` - That not more than one dwelling shall be constructed on the premises for each
100 feet of road frontage; that any house or bungalow erected or maintained shall
cost not less than $12,500.00 and shall be at least 35 feet back from the front

boundary line of the lot, including parch arid piazza. That no outbuildings shall be
v. t erected other than the usual garage, and said garage shall be in connection with or
D joined to the house or bungalow, or so erected that it shall be at least 90 feet
back fram the front boundary line of the lot; that the premises shall be used for
u� dwelling p rposes only; aid nothing which shall be a nuisance, unwholesome or
offensive to the neighborhood shall be permitted on said lot; and that no fowl or
-�' pigs shall be kept on said premises.
BEING AND MENDED to be the same premises conveyed to Fred W. Kaelin by deed
U0 dated January 21, 1970 and recorded in the office of the Clerk of the County of
Suffolk in Liber 6694, page 245 on January 22, 1970.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER withlbe appurtenances
and all the estate and rights of the party of the first part in.and to said premises; TO HAVE AND TO'
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
p AND the party of the first part covenants that the party of the first part lies not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
h.� the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "paries" whenever the sense of this indenture so requires.
