As an addendum to the attached SPUD, the Planning Department has conducted a
review of the proposed modifications pursuant to §280-74 B.(2), and has received a
report from our VVireless Technical Consultant, Cityscape, Inc. (see attached report).
We have the following recommendations for this application:
1. The proposed modifications and up-grades are in compliance with the General
Requirements of§280-70, therefore, we recommend a Building Permit be issued
for this application in accordance with the Structural Analysis Report, dated
March 9, 2015;
2. The Building Permit must state the following:
a. All of Applicant's existing and new feed lines/cables shall be installed
inside the monopole structure; �
b. All feed line access ports shall be sealed to prevent access by any birds or
other wildlife;
c. The facility shall remain secured and protected from unauthorized
personnel. �

Dear Ms. Lanza,
At your request, on behalf of the Town of Southold ("Town"), CityScape Consulta,nts,
Inc. ("CityScape"}in its capacity as telecommunications consultant for the Town, has considered
the merits of the above referenced application submitted by AT&T Mobility ("Applicant") to
modify and upgrade their equipment on an existing one hundred eleven (111) foot monopole
tower, owned by Crown Communications. The tower is located at 21855 Country Road 48,
Cutchogue,New York, see Figure 1.
Support Structure&Ec�uipment
The purpose of the proposed modification is to allow the Applicant to add equipment for
upgrades for fourth generation (4G) advanced wireless services, by replacing antennas and
Remote Radio Heads (RRH) that will support higher speed wireless broadband. These
modifications to the tower equipment will occur at the seventy (70)foot level,Appendix, Exhibit
A. The Applicant currently maintains nine (9) panel antennas; three (3) per sector. Three (3)
new antennas (one per sector) will replace three of the existing antennas at the same locations.
Additionally the Applicant will add three (3) new RRHs to the existing three (3) for six (6)total
RRHs. The new antenna configuration is depicted inAppendix, ExhibitB.
The referenced facility and tower has been designed, constructed and continues to be
operated by the Tower Owner and professionals with expertise in telecommunications site design
and construction. The facility has been designed to maximize the use of telecommunications
facility and will have the capabilit�y to provide space for future collocation opportunities.

Structural Analysis -
The Applicant submitted a structural analysis, prepared by Paul 7. Ford & Company,
dated March 9, 2015 and based on ANSUEIA/TIA-222-F standards. The report summary
indicates that with the upgrades, the tower is still within its design limits, see Appendix, Exhibit
C. Specifically, the tower with the existing and proposed equipment will have a stress rating of
932% while the base (foundation) rating will have a stress rating of 77.6%. CityScape found
that Ne�rtel has removed six(6) antennas at 250 feet and twelve(12) feedlines from the ground to
250 feet. It is unusual for Nextel to remove or decommission a site without converting the same
to a SprintPCS facility, but that apparently did happen since the Nextel electronic equipment
shelter has been removed.
Wireless applications, other than new support structures are governed under the Middle
Class Tax Relief and 7ob Creation Act of 2012 (Tax Relief Act) and sha11 be afforded
streamlined processing with a qualified application. A qualified application under the T�Relief
Act cannot increase in size of the ground compound, or tower structural changes increasing the
height or girth by ten percent (10%) or twenty (20) feet, whichever is greater. Since the
Applicant will not be increasing the height or girth of tower, nor the compound, this application
is qualified for streamlined processing under the Tax Relief Act.
The submitted application confortns to the requirements of Town codes and State of New
York wind codes and structural integrity. Therefore, it is CityScape's recommendation that the
Town a rove the application with the following condition:
The facility sha11 remain secured and protected from unauthorized personnel.

TERMS AV11D CONDITIONS
1. The TOWN OF SOUTHOLD is not responsible for materials,supplies or equipment dElivered
or services performed without authority of written order. Quantities specified are not to be
exceeded.
2. Rlo changes may be made in this order without written authority of the supervisor.
3. Inspection of delivery will be made at delivery point unless otherwise specified. Materials must
be properly packaged. Damaged material will not be accepted. Include itemized packing lists with
all shipments. Delivery indoors is required unless otherwise specified. All prices quoted must in-
clude shipping, handling, packing and crating charges and be F.O.B. delivered, unless other terms
are agreed to. -
4. Substitutions of specified items will not be acceptable. The Town of Southold reserves the
right to reject and return at shippers expense, materials delivered which do not conform to de-
scription of item ordered.
5. If order cannot be filled in whole or in part in time specified, notify the town immediately. In
case of delay in delivery, or in case of any default of the vendor,the town may procure the goods
or services from other sources and hold the vendor responsible for any EXCESS COST, EX-
PENSE OR DAMAGES occasioned thereby.
6. Upon acceptance of this nrde; the ve�+�or agrees to comply with all Federal, State or local
laws relative thereto:
a.The vendor shall defen;! actions or �ia;n;s broughf and hold the Tovvn of Southold, �fs
agents and its employees harrrnless�rom ioss,suits, costs, rights, patent or patent rights of any
invention or any other cause.
b,The vendor represents and warrants that the unit prices charged herein are not higher than
any �pplicable legal maxemum prices permitted, and are not in excess of those currently
charged to other governmental, institutional or commercial users for similar items, quantities
and deliveries.
c. Insofar as applicable, the Vendor shall comply with Sections 220, 220-a, 220-b, 220-c,
220-d, 220-e and 222 of the Labor Law of the State of New York relating to maximum worlc-
ing hours and minimum wages of employees and prohibiting discrimination on account of race,
sex,color, creed or national origin in hiring employees within the State of NewYork involved
in the manufacture of materials, equipment, or supplies specified in this order.
d. The ver�dor shall comply with Sections 103a and 103b of the General Municipal Law
pertaining to disqualifications of contractor for failure to waive immunity before Grand Jury.
7. INVOICES REiVDERED ON ENCLOSED CLAIM FORM MUST BE ITEMIZED IN DETAIL.
Claims for partial deliveries are not allowed unless indicated. Claims in question will constitute a
condition precedent to the right of the vendor or receive any payment and matters of dispute
must be adjusted before fina! acceptance by the Town of Southold.

9. Cash discount terms must be indicated on claim voucher; discount period will be computed

Dear Mr. Bailey:
The Planning Department is in receipt of an application to up-grade an existing New Cingular
Wireless/AT&T facility and related equipment at the existing site referenced above. Pursuant to
§280-130A of the Southold Town Code, the Planning Department is required to provide a brief
report to the Building Department concerning the proposed wireless communications up-grades
to determine whether they meet the guidelines for wireless facilities.
Pursuant to §280-74R(d) of the Town Code, the Planning Board will hire a Technical Consultant
to aid in the review of the application and hereby requires the submission of$4,000.00 into an
escrow account with the Town Comptroller's Office to cover the cost of the Technical
Consultant's review. �
Please remit a check in the amount o�$4,000.00 payable to the Town of Southold. Any unused
_ portion of the Technical Consultant's Fee will be returned to you. This application cannot be
processed any further until we have received this check.
Our consultant is CityScape Consultants, Inc. They may contact you directly regarding this

The wlthin Covenants and Restrictions shall run with the land and shall be
binding upon the Declarant,its successors and assigns,and upon all persons or
entities claiming under them,and may not be annulled,waived,changed,
modified,terminated,revoked,or amended by subsequent owners nf lhe
premises unless and until approved by a majority plus one vote of the Planning
Board of the Town of Southold or its successor,following a public hearing.
If any section,subsection,paragraph,clause,phrase or provision of these
covenants and restrictions shall, by a Court of competent jurisdiction,be

not affect the validity of these covenants as a whole,or any other part or

benefit of and shall be enforceable by the Town of Southold, State of New York,
by injunctive relief or by any other remedy in equity or at law, If a Court of
compefentjurisdlction determines that a violatlon of these covenants and
restrlctfons has occurred,the Declarant(s)shall pay,either directly or by
reimbursement to the Town all reasonable attorney's fees,court costs and other
expenses incurred by the Town in connection with any proceedings io enforce
the provisions of the covenants and restrictions set forth herein. The failure of
the Town of 5outhold or any of its agencies to enforce same shall not be deemed
to affect the validity of this covenant nor to impose any liability whatsoever upon
the Town of Southold or any officer or employee thereof.
