THIS INDENTURE, made the / day of t nineteen hundred and seventy—f i v,!
BE`rWEEN NICK CHARLES residing at 59 Bradley Avenue , in the
Borough of Bergenfield, County of Bergen and State of New Jersey
party of the first part, and CYPRUS & CHARLES N .Y. CO, a partnership ; having,
its place of business at 43 Sound Beach Drive , Mattituck, New
York
party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable considerati,n
paid by the party of the second part, does hereby grant and release unto the party of the second part, the hears-
or successors and assigns of the party of the second part forever,
ALL, that certain plot, niece or parcel of land; with the building_= and imnrni—ents thP.reon erected,
lying and being iia•4� at Mattituck, in the Town of Southold, County of
GD Suffolk and State of New York, known and designated as part of
V'� Lot 13, in Block 1 on a certain map entitled, "Map of Captain Kidd
cc Estates", and filed in the Suffolk County Clerk' s Office on
January 19•, 1949 as Map No . 1672, bounded and described as follows
a( BEGINNING at a point on the northerly side of Summit Drive ,
l said point marking the division line between lots 12 and 13 as
shown on the aforesaid map# running thence along the northerly
side of Summit Drive to Miriam Road on a curve northeasterly
a distance of 115. 19 feet to the division line between lots 13
and 14; running thence northwesterly along said division line
200 feet ; running thence southwesterly through said lot 13 ,
100 feet to the division line between lots 12 and 13 ; running
thence southeasterly along said division line 252 , 03 feet to the
northerly side of Summit Drive at the point or place of. beginning.
Also being lot p3 as shown on the map dated July 22 , 1969 and
recorded in the office of the Clerk of Suffolk County,
SUBJECT to covenants and restrictions of record and zoning
ordinances.
SUBJECT to road easement as shown on map dated July 22, 1969
and recorded.
SUBJECT to easement for the purpose of ingress and egress
to lots 12, 11 and 10 over road from Summit Drive.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenan,is
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND 'IO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such cons.d-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same Cor
any other purpose.
AND the party of the first part covenants as follows: that said party of the first part is seized of the said
premises in fee simple, and has good right to convey the same; that the party of the second part shall quie ly
enjoy the said premises; that the said premises are free from incumbrances, except as aforesaid; that the
party of the first part will execute or procure any further necessary assurance of the title to said premises; aid
that said party of the first part will forever warrant the title to said premises.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
