Herrmann En-Consultants 1319 North Sea Road Southampton, NY 11968 RE: MARILYN ANGELSON 950 PARK AVENUE, MATTITUCK SCTM# 123-7-13.1 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, May 15, 2013 regarding the above matter: WHEREAS, En-Consultants on behalf of MARILYN ANGELSON applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 23, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 15, 2013, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 1 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of MARILYN ANGELSON to construct approximately 258 linear feet of vinyl bulkhead in-place of existing timber bulkhead; remove and replace existing ±52'timber return with ±68' vinyl return; remove and replace fence along top of return; install ±2.5'x14' removable metal steps to beach; and backfill with approximately 100 cubic yards of clean sand fill to be trucked in from an approved upland source; with the condition to establish and subsequently maintain a non-turf buffer from top of bank to bulkhead; and as depicted on the site plan prepared by En-Consultants, last dated April 19, 2013 and stamped approved on May 15, 2013. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) SCTM# 1000-123-7-13.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town,of.Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the Policy Standards and therefore are CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Please note that Wetlands Permit No. 8166 was issued in-May 2013 for the identical work and the replacement of the return running along the end of Marratooka Road, and although the replacement of the return was completed,replacement of the primary bulkhead has not yet been undertaken and-that permit is now expired,necessitating a new approval. However, because the bulkhead is now a"permitted bulkhead,"the Board should be able to issue an Administrative Wetlands Permit for the project pursuant to Section 275-5(B)(2)(i), which allows for an Administrative Wetlands Permit to be issued for the "The construction of a permitted bulkhead, as per§275-11, which is to replace an existing functional bulkhead, subject to the following: [1]That the new bulkhead is constructed substantially similar to the design and measurement of the existing bulkhead; [21 The new bulkhead is in the same location as the existing bulkhead; and[31 Any such operations shall require the addition of a nonturf pervious buffer area." Each of those conditions is met by the current project, including the maintenance of a nonturf buffer area, which was previously required pursuant to Wetlands Permit No. 8166 (copy of covenant enclosed).
