The applicant fails to prove that the action meets the following requirements § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code: (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and A discussion on cumulative impacts of dock density in Mattituck Creek is not provided. [12]• Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. The minimum is determined by evaluating the following factors: (vi) whether or not alternative means to gain access are available. The applicant currently enjoys access to public water via an existing private, unpermitted (no records of permits for the dock were found) dock structure. In the event the action is approved, it is recommended that: 1. That the proposed non-turf buffer is vegetated with native, drought tolerant plants to mitigate the local impacts from the dock structure to public surface waters and bottomlands. 2. Open grate decking is required. 3. Ramp and floats are required to be removed in the winter months and store in upland location. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): The proposed project in part seeks to replace a historically existing,pre-1977 timber bulkhead with a vinyl bulkhead to maintain the property's historical method of protection against erosion and flooding. In addition to the ecological benefit of replacing the treated timber bulkheading with untreated vinyl sheathing, the project would establish a 10'wide nonturf buffer behind the new bulkheading. Otherwise, the project would effectively maintain the historically preexisting conditions along the bulkheaded shoreline without any change in or significant adverse impact on the adjacent unvegetated wetland area or tidal waters of the Town. The project also seeks the construction of a new dock in place of a previously existing dock that was present and functional until recently, which would remain located between similarly constructed, neighboring docks and consistent in character with the greater water body and LWRP-recognized maritime area of Mattituck Creek that is characterized by a great number of similar dock structures. As the dock would also be elevated well above the creek bottom and constructed with untreated decking, its installation would not cause a "fragmentation of ecological communities;"result in the physical loss, degradation,or functional loss of ecological components;or otherwise adversely impact the wetlands or tidal waters of the Town. 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification. A II applicants for perm its*' including Town of S outhold agencies, shall cam plete this CCAF for proposed actions that are subject to the Town of Southold W aterfront Consistency Review Law . This assessor ent is intended to supplem ent other inform ation used by a Town of Southold agency in making a d e t e r m illation of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local libraries and the Town Clerk's office. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III - Policies; Page 2 for evaluation criteria. ❑Yes ❑ No // Not Applicable Attach additional sheets if necessary Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section III - Policies Pages 6 through 7 for evaluation criteria Yes No Not Applicable The proposed dock will be consisting with Policy 3 because it will replace a similar, previously existing dock(present since at least 1980)and will be located between similarly constructed, neighboring docks and consistent in character with the greater water body and recognized maritime area of Mattituck Creek, which is characterized by a great number of similar dock structures. Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III- Policies Pages 8 through 16 for evaluation criteria Yes No M Not Applicable Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria Yes No Not Applicable To the extent that Policy 5 is applicable, the proposed dock will be consistent because it will be constructed with untreated decking to minimize any potential water quality impacts associated with pressure treated lumber. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. Yes No Not Applicable 1 Due to the historical existence of a dock si re at this property and the presence of signif numbers of adjacent and neighboring dock structures, installation of the proposed dock will not cause any"fragmentation of ecological communities,"nor will construction of the dock result in the physical loss, degradation,or functional loss of ecological components. The catwalk will be of open-pile construction, elevated well above the creek bottom and not over any vegetated marsh of SAV and constructed with untreated decking. The project will meet the statutory and regulatory requirements of Town Code Chapter 275,Wetlands,and New York State DEC, Article 25,Tidal Wetlands Act. Attach additional sheets if necessary Policy 7. Protect and improve air quality in the Town of Southold. See LWRP Section III — Policies Pages 32 through 34 for evaluation criteria. Yes No M Not Applicable Attach additional sheets if necessary Policy 8. Minimize environmental degradation in Town of Southold from solid waste and hazardous substances and wastes. See LWRP Section III - Policies; Pages 34 through 38 for evaluation criteria. Yes No M Not Applicable • PUBLIC COAST POLICIES Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. See LWRP Section III - Policies; Pages 38 through 46 for evaluation criteria. M Yes Non Not Applicable The proposed dock is located among and in line with numerous other docks along this Mattituck shoreline, including the adjacent docks to the north and south;and while the soft sediment bottom seaward of the bulkhead does not lend itself to being used for pedestrian public access along the shoreline, any such access would remain unimpeded due to the height of the dock above grade. Therefore the dock will not interfere with pedestrian access along the shoreline or with navigation on Mattituck Creek and is thus consistent with Policy 9. Attach additional sheets if necessary WORKING COAST POLICIES Policy 10. Protect Southold's WI., rdependent uses and promote sitii f new water-dependent uses in suitable locations. See LWRP Section III - Policies; Pages 47 through 56 for evaluation criteria. Yes n No Not Applicable For reasons described above, the proposed dock would neither alter nor adversely impair the surrounding community character, water use,or scenic quality of the surrounding environs of Mattituck Creek, which is recognized by the LWRP as a regional maritime center where construction of piers facilitating water dependent use by recreational vessels is encouraged.
