residing at (no street #) Sound Avenue, Mattituck, NY, as tenants in common with-
out right of survivorship.

Witnesseth, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by

and assigns of the party of the second part forever,
44 All that certain plot, piece or parcel of land, with the buildings and Improvements thereon erected,situate,lying and
being*xdw at Mattituck, in the Town of Southold, County of, Suffolk and State of New
\� York, bounded and described as follbws:
BEGINNING at a point on the easterly side of Grand Avenue
where same is intersected by the southerly line of land now or formerly of Linville G.
Farrow, said point being distant 581.91 feet southerly as measured along the easterly..
side of Grand Avenue, from an angle point in said easterly side of Grand Avenue and
running thence along said land of Farrow and along land now or formerly of Joseph
U Michalecko north 59 degrees 05 minutes east 317. 93 feet; thence along other land of
Atlantic Homes of Suffolk, Inc. : (1) south 10 degrees 29 minutes east 135.00 feet:
and (2) south 59 degrees 05 minutes west 319. 61 feet to the easterly side of Grand
Avenue; and thence along the easterly side of Grand Avenue (1) north 9 degrees 51
minutes west 2.55 feet; and (2) north 9 degrees 49 minutes west 133.05 feet to the
point or place of BEGINNING.
SUBJECT TO: (1) any state of facts an accurate survey might
show; (2) covenants, restrictions, easements, agreements, reservations. and
zoning regulations of record; (3)mortgages held by the Southold Savings Bank, recon
in Libers 6509 mp 18 and 6676 mp 372, as consolidated upon which there is now due
and owing the principal amount of $26, 341.80, which the party of the second part
agrees to assume and pay, and to that end joins in the execution and acknowledgement '
Q of this instrument.
BEING AND INTENDED TO BE the same premises conveyed to
the party of the first part by deed made by Roy W. Tate and Joan G. Tate to Joan
G. Tate , dated July 12, 1973 and recorded in the office of the Clerk of the County of
Suffolk in Liber 7448 at page 105 on the 23rd day of July, 1973.
Together with all right,title and interest, if any, of the party of the first part in and to any streets and roads abutting
the above described premises to the center lines thereof; Together with the appurtenances and all the estate and a
rights of the party of the first part in and to said premises;To Have And To Hold the premises herein granted unto the
party of the second part,the heirs or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever,except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party Of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust i 1
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to She pay- f
ment of the cost of the improvement before using any part of the total of the same for any other purpose. {
The word "party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
