NAME OF APPLICANT: Paul Romanelli, Contract Vendee(Robert and Carol Bohn)
PROPERTY LOCATION: 50300 NYS Route 25 (corner Jockey Creek Drive) Southold,NY. SCTM#1000-70-2-15
PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 28,063 sq. ft. parcel located
in the RO zone, with 150 feet of frontage on Main Road (aka SR 25), and 207.35 feet of frontage on Jockey Creek
Drive, 106.57 feet along the eastern property line and 200.00 feet on the north property line. To the north and west,
the parcel is adjacent to other parcels also in the RO zone, and is also nearby to neighborhoods with other
residential use parcels in the R-40, AHD, and AC zones. To the east and south, the parcel is adjacent to parcels in
the R-40, B, and MI zones. The property is improved with an existing one and half story single-family dwelling
operating as a real estate office. All shown on the survey dated August 11, 2003 prepared by Nathan Taft Corwin,
III, LS.
BASIS OF APPLICATION: This is a request under Section 280-146D for an Interpretation of the Town Code,
Article VIII, Section 280-38A, "Permitted Uses", appealing the Building Inspector's September 15, 2015 Notice of
Disapproval; applicant's business "Suffolk Security" is not a contractor's business.
RELIEF REQUESTED: The applicant requests that the ZBA makes a determination that the applicant's alarm
installation and maintenance business is not a conventional contractor's business, but is in fact the kind of small
business use that is permitted in the RO zone. The applicant maintains that the business is similar to other "small
business offices such as insurance agencies, real estate agencies, computer software services, financial planning
securities brokers and like kind small business establishment, excluding retail sales of any kind or nature, and
limited to overall floor space of 3,000 square feet." as defined in Town Code Article VIII Section 280-38A.
ADDITIONAL INFORMATION: The property was included in the "A-Residential" zone at the beginning of
zoning in 1957. In 1979, with ZBA Appeal #2516, this property was granted a use variance that permitted the use
of"one general business office, or professional office". Since 1979 the location has contained an "existing legal
non-conforming real estate agent office" as described by the Town Building Dept. in their Notice of Disapproval
dated Sept. 15, 2015. In 1989 the property was re-zoned, and included in the RO zone. Part of the subject building
is used as a legal residence.
In conjunction with this request for a code interpretation, the applicant has filed a request for a use variance (ZBA
file # 6890) which the Southold Town Planning Board stated they do not support in a memorandum dated Oct. 20,
2015. If it is determined by the Board of Appeals that the applicant's business is a permitted use,then the requested
use variance will no longer be relevant or necessary,
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on November 5,2015, at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property
and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
In addition to submitting written documentation, at the public hearing the applicant stated the following:
1. He does not use or store large amounts of materials, such as spools of wire, ladders or construction
materials on site. He asserted that the business does not maintain any type of contractor's yard, or keep a
large amount of inventory in stock. Most of the inventory consists of small modular units similar to
computer components and all deliveries to the business are via UPS vans. Storage will be in the basement
of the subject building.
2. There is one full-time and one part-time employee in the office during the day. He further stated that there
are at most 1-2 customers per week that come into the office with questions or to pay their bill which the
applicant claims to be similar to the type of computer software service that is permitted in the zone district.
There is no retail sales conducted on site.
3. There are four small"sprinter vans"used by the four installers which will be parked on site in the existing
parking area and no heavy equipment is used and vehicles do not require NYS DOT registration required.
4. The business will retain the residential appearance of the building, as is customary to most buildings in the
RO zone. The onsite building occupies less than 1,000 sq. ft. and is 3% of the property area.
5. The applicant provided a verbal explanation with copies of his licensees which include a"control license"
from NYS Department of State as an alarm installer and a Suffolk County RES license defined as a
"communications cable installer."
RESOLUTION OF THE BOARD: In considering all of the above factors motion was offered by Member Horning,
seconded by Member Goehringer, and duly carried,to
Determine that the subject business, Suffolk Security, is an alarm system installation and maintenance company
operated by the applicant, Paul Romanelli, that is a"similar and like-kind of business" to those defined in Town
Code Section 280-38 as permitted uses in the RO Zone. Therefore, Suffolk Security may operate their business as a
permitted use in the proposed RO location and the applicant's request for a use variance (ZBA#6890) is no longer
relevant or necessary.
NOTE: The Building Department's Notice of Disapproval states that site plan approval is required by the
Planning Board
Vote of the Board: Ayes: Members Weisman (Chairperson), Horning, Dantes, Goehringer. Member Schneider
abstained. This Resolution was duly adopted(4-0-1).

1. The Building has a pre-co#z16475 and a business office granted by the Zoning Board of
Appeals on 2/8/79#2516. Contract Vendee, Paul Romanelli is the owner and operator of
Suffolk Security Systems Inc. The company is asecurity alarm vendor that installs security
and life safety systems in homes and businesses to alert for such emergencies as fire and
carbon monoxide, burglary, low temperature and medical emergencies. 'The
communication from the site to Suffolk Security's central alarm station located in Union,
New Jersey, occurs over telephone lines, cellular and internet. Within the home or office
wireless systems are often used.
Facts: RO zoning allows "small business offices"such as and listed,by example, "computer
software services". Suffolk Security installs alarm security throughout the east end using
the internet and cellular network. Suffolk Security business generally has no client traffic,
the contracts are negotiated and executed by phone/computer or mail. Similar to a
computer software company which typically installs or repairs the computer systems in the
home or office,the alarm systems also installs the security systems at the consumer's
location(business or home).
Identical to real estate and other licensed professionals (permitted uses in,RO), Suffolk
Security must be licensed through New York State Department of State. If you were to
research the NYS Department of State data base for licensed professionals, Suffolk
Security is listed.(See attached)
Also identical to "computer software services", Suffolk Security maintains a Suffolk
County Restricted Electrical License. This special license is issued also to computer
software companies which authorizes work with low voltage electricity.
As with any small business office,installations are coordinated through the office. The
equipment required for his business are small computer units (remote communication
devices) and electric wires. Sensitive computer& electrical equipment for Suffolk Security
business fits into one small room.
2. Suffolk Security operates from a business office. Suffolk Security would not be considered
a contractor and his business does not require a Suffolk County Contractor's license.
Suffolk Security is a N.Y. State licensed business.
As thecodestates at 280-38 A. (g) small business offices such as insurance agencies, real
estate agencies, computer software services, financial planning securities brokers and
"like-kind small businesses"are permitted uses in RO zoning. All these businesses are NY
State licensed businesses. As I stated above, as with the listed uses, Suffolk Security
maintains two separate specific licenses (N.Y. and Suffolk County). Also as with small
businesses, Suffolk Security does not generate customer traffic,there are no retail sales of
merchandise, deliveries are by typical office delivery carriers such as Federal Express/UPS
and there are few employees. Mr. Romanelli and a secretary are in the office.
The property has been used for over 20 years as a real estate office. -Sharpe Real Estate
occupied the property in 1979. The Zoning Board granted a limited use variance because
the parcel was not suitable for residential use. This use variance (appeal#16475)permits

the Board to review the proposed use by Suffolk Security and "interpret"that the proposed
use by Suffolk Security is no more intensive than the real estate office. In fact the parking
and traffic generated by the former tenant, Daniel Gale, and the large number of sales
agents and brokers, generated greater intensification of use than Suffolk Security Systems
Inc.. The traffic generated by a busy real estate office exceeds the activity anticipated by
Suffolk Security.

After investigation, inspection and public hearing, the BAcIARD OF APPEALS
has determined that the applicants are the owners of a deteriorated
four, shingled cottage which was moved to the present location in
1937 at roadside on the original family farm on the southeasterly
side of Route 25, the main road, entering the hamelt of Southold
from the west in an area which was largely agricultural and residen-
tial at the outset of zoning in 1957, and was zoned A residential at
that time. The applicants' lot now consists of approximately 28,000
square feet or 2/3 of an acre with 150 feet of frontage on Route 25
and 215 feet on Jockey Creek Drive.
The lot adjoining to the north and east is owned by the Christian
Science Church while two street form the other boundaries of the
applicants' property. DirectlyacrossJockey Creek Drive is an area
bordering Route 25 which is zoned "C" industrial and is presently
occupied by a hardware store and a marina where boats are offered for
sale and displayed at roadside. A few feet from the marina, Route 25
is intersected across the street by Ackerly Pond Lane. The existence
of businesses in close proximity to the applicant's residentially zoned
property as well as the increasing traffic conditions and the fact
that the property is surrounded on two sides by church property have
contributed to the extreme difficulty in attempting to sell or rent
for residential purposes. Applicants' attempts to sell or rent via
local brokers have been without success over a two year period.
William B. Smith appraises the property at $29,500.00 "as is" and
$43,500.00 if zoned for business. To put the cottage in a livable
condition would require improvements estimated to cost about $20,000.00
and require a monthly rental payment of $250.00 merely to cover taxes,
interest and carrying charges according to the Southold Savings Bank
with no return on principal or interest. This compares with a possible
rental return of an estimated $175.00 to $200.00 per month for a four
room cottage. A fair return for the property seems unattainable when
used for residential purposes as zoned. Brokers testified that they
were unable to elicit any interest for residential use. Under these
circumstances the applicants sought a change of zone recommendation
from the Planning Board; however the Planning Board suggests a limited
business use, limited to general or professional office use.
As a Buffer between several different uses of nearby property, a
limited use variance emerges as a solution to the problem of relieving
a unique and unusual hardship, where the owners are unable to attain
a fair return, a situation which has developed over the years and is
certainly not due to any actions of the applicants. Such a use vari-
ance meets with the approval of the Christian Science Church (to whom
the property was offered) as well as neighbors to the east on Jockey
Creek Drive, for whom a zone change is undesirable.
Our investigation confirms the fact that the applicants are unable
to obtain fair market value for their property as zoned for residential
use either by sale or rental. The hardship is not self-imposed. The
effect is confiscatory and results in severe economic hardship to the
applicants.
Accordingly, we believe in view of these findings and with the
dual purpose of relieving the applicants' situation and establishing
a suitable buffer zone between varying uses of adjacent properties, a
strictly limited use should be permitted.
On motion by Mr. Tuthill, seconded by Mr. Grigonis, it was
RESOLVED, that Susan H. Terry, c/o Eastern Suffolk Nursing Home,
Greenport, New York, and Edith M. Terry, Jockey Creek Drive, Southold,
New--York, be GRANTED permission to use premises for one general busiw -
ness office or professional office. Location of property: Main Road,
Southold, New York, bounded on the north by Christian Science Society;

by Main Road (State Road 25) , upon the following conditions:
1. The above use is permitted in the B Light Business District;
Article VI, A. permitted uses (2) . All other uses of the property
either more or less intensive are prohibited including all other
light or general business uses or residential uses. Any question
arising from this condition shall be decided by the Board of Appeals.
2. No portion of the premises may be used or sublet for pur-
poses other than the intended use of the premises in this action.
3. A ten car parking lot of not less than 3500 square feet ex-
clusive of land devoted to entrances from Jockey Creek Drive and Route
25 shall be constructed prior to occupancy. Entrances shall be at
least 50 feet from the intersection of Jockey Creek Drive and Route
25. Driveway and parking lot surfaces shall be dust free preferably
bituminous. No portion of the parking lot shall be within the front
yard set back from Route 25 established by the present cottage; how-
ever a portion of the front yard established on Jockey Creek Drive
may be used if necessary in determining the location of the parking
lot. No portion of the parking lot shall be closer than 15 feet to
any lot line.
4. All surface run-off water and drainage shall be contained on
the premises. Adequate drainage structures will be required, if nec-
essary.
5. Before use of the premises may begin, a Certificate of Occu-
pancy will be necessary from the Building Department in accordance
with Artible XIV, Section 100-144.
6. Approval of the Suffolk County Planning Commission.

A. INSTRUCTIONS

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.

The following describes the business of Suffolk Security Systems. Should you have any
questions related to the below,the president of Suffolk Security, Paul Romanelli,will be present
at the Zoning Board hearing to address your questions.
Suffolk Security Systems is a NYS licensed security and fire alarm installer. Our business is 80%
residential, 20% light commercial. There are four full-time employees in addition to myself.
Aside from myself, there is only one other full time employee in the office during the day and an
occasional part-time, in-office seasonal employee. The remaining staff consists of three full-time
alarm technicians. We have very little customer traffic to our office (at MOST, 1-2 customers per
WEEK) as most of our business is conducted via US mail and the Internet.
We own four vans. One is an old larger van that is for sale and will not be coming to the new
site. One is Chrysler Sprinter(the smallest one they made)that when it's time to retire it will be
replaced with a smaller Ford Transit Connect(mini-van). The other two are Ford Transit Connect
mini-vans. Because of technology changes, we no longer require large vans for our work.
Our Central Station operations are located in a New Jersey, U.L Approved call center and we
have no intentions of moving that business to Southold. We have been at our current location
since 1999. Technology has changed dramatically in the last 15 years - our systems are smaller
and install more efficiently than ever. That's why, despite our growth, we can maintain a small
staff of technicians. An entire control panel is now is about 8-1/2" by 6" in size.
We hold a New York State alarm installers license from the NYS Department of State. It is NOT
a contractor's license but rather a "control" license because I need to be background checked and
fingerprinted for installing alarm systems as well as all my employees. I have attached the list of
trades that the NYS DOS maintains licenses for-NONE of them are contractors. The trades
include real estate appraisers, home inspectors and notaries - all of whom must be fingerprinted
and background checked. (See attached licenses)
In Suffolk County,we hold a Restricted electrical license. Specifically, it's an RE5 license -
defined as a "Communications Cable Installer." Specifically, anyone (except licensed Master
Electricians AND licensed NYS alarm installers)in Suffolk County that works with all things
low voltage (under 90 volts) is required to hold an RE5 license. That means all telephone wiring,
network wiring, and audio wiring requires the RE5 license. Does that make me a contractor? I
doubt it. A guy selling stereo systems or a computer technician requires the same license. I hold
that license ONLY because we do install audio systems on occasion and our alarm systems now
connect to the Internet! (See attached Suffolk County License)

I have mentioned this point before but according to the Building Inspector, Mike Verity, if I show
up in the Suffolk County Consumer Affairs database, he defines me as a contractor. This is
incorrect,the same database is used for Pet Cemeteries and Polygraph examiners and they are
certainly not contractors! I have also attached the list of the licensed occupations that are in the
Suffolk County Consumer Affairs database. Only a few are contractors.
I hope the following information is useful for to Board to conclude that no "use variance" is
required. That Suffolk Security Systems is a permitted use in RO zoning. Moreover,this small
business will be perfectly suited for the subject property which has a limited use variance for a
business office (formerly a real estate office). Suffol Security Systems is a licensed business
equivalent to other licensed professionals or businesses listed as permitted uses in RO zoning.

Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of The Suffolk Times.
1) Before Ocotber 19th:
Please send the enclosed Legal Notice, with both a Cover Letter including your telephone
- number and a copy of your Survey or Site Plan (filed with this application) which shows the
new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, to all owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Southold Town Assessors' Office, or Real Property Office at the County Center, Riverhead. If
you know of another address for a neighbor, you may want to send the notice to that address as
well. If any letter is returned to you undeliverable, you are requested to make other attempts to
obtain a mailing address or to_ deliver the letter to the current owner, to the best of your ability,
and to confirm how arrangements were made in either a written statement, or during the
