HomeMy WebLinkAboutLP-11/10/2015 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, November 10, 2015 at 7:00 p.m. Town Hall Annex Executive Board Room Members Present: John Sepenoski, Chairman Sam McCullough Eric Keil Peggy Dickerson Lillian Ball Members Absent: Maureen Cullinane Anne Murray Also present: Melissa Spiro, Land Preservation Coordinator Bob Ghosio, Town Board Liaison Tim Caufield, PLT Vice President Commencement:  The meeting began at 7:05 p.m. with five LPC members present. Adoption of Meeting Minutes:  Acceptance of LPC meeting minutes from October 27, 2015. MOTION made by Sam McCullough, seconded by Eric Keil, to accept the 10/27/2015 LPC meeting minutes. Motion carried: 4/0/1 (LPC member Lillian Ball abstained as she was absent from the 10/27/2015 LPC meeting.) Land Preservation Applications and Inquiries:  SCTM #73.-1-1 and 73.-2-4 (THE VINES) Review PDR application and status of purchase offer LPC reviewed revised “red-line” conditions presented by applicant in regard to purchase offer. LPC revised applicant’s proposed condition, to allow applicant to terminate after specific timeframe, to include that termination would occur at the specific timeframe unless both parties agree to an extension. The LPC discussed the red-line format for the applicant’s proposed conditions and did not accept the applicant’s format of revising the LPC purchase offer letter. Applicant’s conditions should be included as an attachment to the original purchase offer letter. MOTION made by Sam McCullough, seconded by Peggy Dickerson, to inform “The Vines” representative that the revised red-line changes made to the LPC’s original offer letter dated August 31, 2015 were acceptable with the addition that the Final Agreement will be terminated at the proposed termination date unless both parties agree to an extension. Motion carried: 5/0 MOTION made by Eric Keil, seconded by Sam McCullough, to extend purchase offer timeframe until December 31, 2015 for applicant to respond to LPC’s current purchase offer. Motion carried: 5/0  SCTM #1000-96.-5-12.1 (THE ROMAN CATHOLIC CHURCH OF THE SACRED HEART) Review of LPC application Land Preservation Coordinator Melissa Spiro went over her discussion with Mike Amoroso and his request to amend LPC’s October 27, 2015 determination and to instead proceed with appraisal process prior to making an application to Planning. MOTION made by Eric Keil, seconded by Lillian Ball, to direct Land Preservation Coordinator Melissa Spiro to commission an appraisal for the value of a development rights easement on the proposed farmland area of SCTM #1000-96.-5-12.1. Motion carried: 5/0  SCTM #1000-14.-2-29.2, 29.3 & 29.4 and 19.-2-2, 3 & 12.2 (ORIENT POINT LLC aka Pappas/Vasilas) Review PDR application Land Preservation Coordinator Melissa Spiro went over request to re-activate application from 2010 for Town PDR and Conservation Subdivision. Melissa noted that applicant had not present same to Planning. MOTION made by Lillian Ball, seconded by Peggy Dickerson, to direct Land Preservation Coordinator Melissa Spiro to commission an appraisal subject to application meeting with Planning staff in regard to concept and application status. Motion carried: 5/0  PROJECT STATUS UPDATES \[executive session where applicable\] EXECUTIVE SESSION. The LPC members entered into Land Preservation Coordinator Melissa Spiro presented status updates on new and pending projects. END OF EXECUTIVE SESSION SCTM #1000-69.-1-8 (ZEBROSKI) Status report LPC discussed status of potential sale of property and potential for simultaneous sale of property and development rights easement. LPC authorized Land Preservation Coordinator Melissa Spiro to discuss purchase of development rights easement with landowner, Bill Zebroski. Applications & Inquiries for Uses or Structures on Preserved Property  SCTM #1000-69.-3-10.8 (FLOWER HILL BUILDING CORP) Request to clear paths Land Preservation Coordinator Melissa Spiro discussed landowner’s request via e-mail to clear building lot to provide access to it and to widen some of the existing paths within the area subject to development rights easement. LPC reviewed request to widen existing paths only as building envelope is not within easement area. LPC determined that the recorded easement allows widening of the paths as requested.  SCTM #1000-19.-1-1.4 (MAUREEN CULLINANE) Request for deer fence The Land Preservation Committee received your Request for Agricultural Structure Placement on PDR Lands dated 10/27/2015 in regard to installing deer fencing on the above mentioned property. LPC noted that installation of deer fencing is consistent with the terms and conditions of the recorded easement for the property.  SCTM #1000-74.-5-15 (ACKERLY POND VINEYARDS aka JILL BLUM) Request for deer fence The Land Preservation Committee received your notification dated 11/4/2015 in regard to installing deer fencing on the above mentioned property. LPC noted that installation of deer fencing is consistent with the terms and conditions of the recorded easement for the property.  SCTM #1000-100.-4-4.2 (MARTIN SIDOR) Request for deer fence The Land Preservation Committee received your notification in regard to installing deer fencing on the above mentioned property. LPC noted that installation of deer fencing is consistent with the terms and conditions of the recorded easement for the property. Stewardship and Management:  EASEMENT MONITORING Not discussed. General Land Preservation Items:  FINANCIAL UPDATE \[executive session where applicable\] EXECUTIVE SESSION. The LPC members entered into Land Preservation Coordinator Melissa Spiro reviewed funding status updates with LPC members. END OF EXECUTIVE SESSION  CONTINUATION OF DISCUSSION: LIST OF PROPERTIES FOR SALE Land Preservation Coordinator Melissa Spiro presented mapped view of farmland/open space currently on the market for sale that could be potential preservation projects. Next Regular Meeting:  Tuesday, November 24, 2015. The next regular meeting will be on LPC Chairman John Sepenoski will be unable to attend this upcoming meeting.
