Wilcenski, Planning Board Chairman D�111 Date: December 13, 2012 Re: Planning Board Recommendations—Ovsianik Change of Zone, 97-2-15 & 16.5 We have reviewed the request for comments on the revised plan (map by John C. Ehlers Land Surveyor, last revised date 06/07/2012) for the application referenced above. This revised plan has changed from the original submitted in 2011, in that the new proposed zoning district line for the B zone has been shortened by 30 feet, where it originally was proposed to extend to the adjacent residential parcel. In our previous review, we summarized the history of the events that led to the situation found today—a building that crosses the property line with a non-permitted use in one of the two parcels it occupies. Our review of this situation and the proposed remedy follows. This situation can be remedied by a lot line change together with a zone change, however the site will then become available for all the uses allowed in the Business (B) zoning district, with potential for adverse impacts to the adjacent residential zone. Should the Town Board choose to proceed with a zone change to Business (B) zoning district on a portion of tax parcel 97-2-16.5, the Planning Board recommends that the area to be re-zoned extend only as far east as needed to provide a 25' side yard to the existing building(not including the trailer shown on the plan). This is the required minimum side yard setback for the B zone. This will provide 25 feet between the existing building and the new zoning district line and creating a much larger and necessary buffer between-the new B zoned area and the nearby residential property. Although the Planning Board's recommendation to reduce the area to be rezoned will result in the new B zone parcel to be much smaller than the zoning requires, it will ensure that a sufficient buffer is maintained between it and the residential property to the east. In addition to the zone change(Town Board) and the lot line change(Planning Board), there are several additional steps that will be required to bring the site into compliance, including an amended site plan from the Planning Board, as well as a review of the Special Exception permit an area variance and possibly a setback distance variance by the ZBA. The Town Board should consider a condition on the zone change that the necessary steps be taken by the applicant to bring the site into compliance or the new zoning designation will be revoked. The remaining area of tax parcel 97-2-16.5 is recommended to remain in the R-80 zoning district. The request for Residential Office zoning on the remainder of Parcel 16.5 should not be contemplated until after the Comprehensive Plan update is completed. To summarize: 1. The Planning Board recommends the zone change from R-80 to B on a smaller portion of tax parcel 97-2-16.5 than proposed; and 2. That portion to be rezoned to B should extend only 25 feet east of the existing building (see sketch of recommended new zoning line attached); and 3. That the remainder of tax parcel 97-2-16.5 continue to be zoned R-80 4. The Planning Board further recommends the rezoning be conditioned on all the other approvals necessary to bring the site into compliance to be done in a certain time-frame. These other approvals include,but may not be limited to the following: a. Zoning Board of Appeals (to be determined by ZBA & Chief Building Inspector) i. Special Exception use review ii. Area variance for size of the new lot iii. Area variance for rear yard setback iv. #of uses on site b. Planning Board i. Lot line modification ii.
