Ciaglo SCTM #1000-69-4-8.5 (formerly 8.2) On July 30, 2012, this Office received a Memorandum from the Town Clerk's Office requesting the review-of the property that is the subject of this Change of Zone Application. Below is a summary of the Application: 1. The property is located on the south side of Route 48 in Peconic. A copy of the tax map highlighting the property is attached. 2. The property has the following characteristics: a. Size: 1.25 acres; b. Present zoning: AC (2-acre); c. Existing buildings: single-family residence and several storage buildings (which house the Applicant's landscaping business). The property does not have a CO for a landscaping business; d. Proposed Zoning —LI (Light Industrial) —the property owner is attempting to legalize his present use of the property; and e. Uses permitted in the LI zone (1-acre zone) i. Agricultural operations and accessory uses; ii. Government buildings; iii. With site plan approval —wholesale businesses, warehousing, building materials storage and sale, Office Buildings, Contractors' businesses or yards including landscapers' yards, wineries, auto repair shops and other light industrial uses; and iv. With Special exception —research, design or development laboratories, laundry or dry-cleaning plants, conference facilities, light industrial uses, public utility structures, truck or bus terminals, food processing and packaging plants, and repair of boats and marine items. , 1 , 3. Issues with the Application: a. The Application does not include a copy of the deed; b. Item #8— Existing building area and lot coverage is not completed; c. Applicant's survey does not indicate the proposed rezoning requested; d. Application throughout refers to an incorrect tax lot number 8.2. The present tax lot designation is lot 8.5; e. The written statement attached to the Application (#9) does not discuss the design concept, the present use of the site, how the proposed use is consistent with the Town's comprehensive planning documents, nor does it state reasons why the proposal cannot be built under current zoning; f. Disclosure Affidavit is not properly notarized; g. Environmental Assessment Form (EAF): i. Total acreage noted on the EAF, 1-acre, is inconsistent with the total acreage noted on the Application, 1.25; ii. EAF states that the rezoning would not create any new jobs, but the description of the project indicates that the proposal would "create new opportunities for growth and employment"; and iii. The EAF notes that no other approval would be needed. However, it appears that site plan approval would be required for the Applicant to use the property as a landscaper's yard. 4. Present violations on the site are listed below and have been pending in Justice Court since 2011: a. Section 280-13(A)(1) non-permitted use; two dwellings on one lot; b. Section 144-8(A)(1) construction without a Building Permit; c. Section 280-13(A) non-permitted use; landscape contractor's yard; and d. Section 280-13(A) non-permitted use; truck hauling business. This application does not meet the criteria for acceptance for filing by the Town. It is missing one of the most important aspects of the application -#9 —which requires the submittal of the following: A detailed typewritten description of the project, the proposed use and operation - thereof, including a detailed explanation of the design concept, the reason for the particular design,-objective of the developer or project sponsor and how or why the project is (or is not) in compliance with the Town Code and the Master Plan. Explain what benefits will accrue to the community by the proposed rezoning. Document the reasons why the proposed project cannot be built under current zoning regulations and pursuant to the current zoning map. The application form "Request for Amendment and/or Change of Zone" is incomplete with some questions left blank, most notably question #8. - The Notice to Adjacent Property Owners forms are not dated and there is no proof that they were mailed. The change of zone application requires these notices to be sent prior to the application being submitted to the Town. The map submitted is missing the required zoning,district notations, as well as notations identifying landowners and land uses within 500' of the subject property. It also appears to be missing some detail as to the layout and current use of the property including the dimensions of the existing structures on the property. The property is stated as being 1.25 acres (54,500 s.f.) in size. The minimum lot size for the Light Industrial Zone is 40,000 s.f., meaning there can only be one principal use (building) per 40,000 s.f. From the survey submitted, there appears to be both a residence and another building on the property. The application must include all the relevant information about these buildings and their uses both existing and proposed. While it is recommended that the Town Board require all the relevant information be submitted prior to accepting this application for review, enough information has been submitted to make an initial recommendation on the change of zone request. The Planning Board recommends that the Town Board elect not to consider this change of zone at this time due to the pending Comprehensive Plan update.
