LAND PRESERVATION COMMITTEE MEETING
Minutes & Discussion Notes from Meeting held
Tuesday, October 27, 2015 at 7:00 p.m.

Commencement:
The meeting began at 7:05 p.m. with six LPC members present.
Adoption of Meeting Minutes:
Acceptance of LPC meeting minutes from October 13, 2015.
MOTION
made by Sam McCullough, seconded by Anne Murray, to accept the 10/13/2015 LPC
meeting minutes, as amended.
Motion carried: 5/0/1 (LPC member Peggy Dickerson abstained as she was absent from the
10/13/2015 LPC meeting.)
Land Preservation Applications and Inquiries:
SCTM #1000-96.-5-12.1 (THE ROMAN CATHOLIC CHURCH OF THE SACRED HEART)
Review of LPC application
Land Preservation Coordinator Melissa Spiro presented background information on LPC application.
The Roman Catholic Church of the Sacred Heart has retained new legal counsel who is providing
Melissa with further information on the proposed project. A land exchanged has been authorized
between RC Church of the Sacred Heart (landowner) and the abutting parcel owned by Our Lady of
Ostrabrama which would provide access to farmland from Depot Lane. The landowners intend to
apply to the Planning Board for this lot line modification and to subdivide the area being used as a
cemetery from the area that is currently being farmed.
MOTION
made by Sam McCullough, seconded by Peggy Dickerson, to direct Land Preservation
Coordinator Melissa Spiro to commission an appraisal for the value of a development rights
easement on the proposed farmland area of SCTM #1000-96.-5-12.1 provided landowners, or its
agent, submits an application to the Planning Board for the proposed lot line modification to provide
access to the farmland.

Land Preservation Coordinator Melissa Spiro presented status updates on new and pending projects.

MOTION
made by Sam McCullough, seconded by Maureen Cullinane, to direct Land Preservation
Coordinator Melissa Spiro to inform “The Vines” representative, that the red line changes made to the
LPC’s original offer letter dated August 31, 2015 were not accepted and that the offer remains as
written.

Property owners requested LPC to reactivate their 2010 LPC application re: conservation subdivision
on Old Main Rd, Orient Point.

EASEMENT MONITORING
SCTM #1000-83.-2-9.3 FILIBERTO fka Manzi Trust/Villa Amorosa

Monitoring of the Filiberto (fka Manzi Trust/Villa Amorosa) development rights easement
showed that a neighbor to the west is encroaching on the Town’s easement, having
established a residential driveway across preserved land from the cul-de-sac on the Filiberto
property. Town research has found that said neighbor has a recorded legal access to the
residential home across properties to the west, and that no such legal access from the
Filiberto property to the east was provided when the Town purchased the easement in 2005.
LPC directed Melissa Spiro to contact Filiberto and notify him that the encroaching driveway
across PDR land is an easement violation that needs to be rectified.

Land Preservation Coordinator Melissa Spiro presented mapped view of farmland/open space
currently on the market for sale that could be potential preservation projects.
