Present were: Keith McCamy, Acting-Chairman Doug Hardy, Member Peter Meeker, Member Jack McGreevy, Member John Stein, Member Lauren Standish, Secretary Absent were: Peter Young, Chairman James Dinizio, Town Board Liaison CALL TO ORDER The meeting was called to order at 4:35PM by Acting-Chairman Keith McCamy. REPORTS John Stein attended the Board of Trustees meeting held on Wed., September 16, 2015. The Board of Trustees approved a project for a bluff restoration that was not reviewed by the CAC and did not have an LWRP report. According to the Trustee Bredemeyer, the application was received after the submission deadline. It was suggested by the CAC members to draft a memo to the Supervisor and the Town Board, however, John offered to contact Jim Dinizio directly, as the Town Board liaison to the CAC. Jack McGreevy updated the members on the status of the Draft Dredged Material Management Plan and Draft Programmatic Environmental Impact Statement for LI Sound. Supervisor Russell submitted comments to the US DMMP/PEIS Project Manager for the Corps. of Engineers, on behalf of the Town. 2 APPROVAL OF MINUTES Moved by Doug Hardy, seconded by Jack McGreevy to Approve the Minutes of September 9, 2015. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Doug Hardy, seconded by Peter Meeker, it was RESOLVED to SUPPORT the application of CROSS SOUND FERRY SERVICES to install temporary berthing dolphins, construction of a new bulkhead, as well as removal and rehabilitation of the existing vehicle access ramps, and the replacement of the ramp support stanchions. Located: 41270 Main Road, Orient. SCTM#15-9-16 Inspected by: Doug Hardy, Peter Meeker The CAC Supports the application and recognizes the importance of the Cross Sound Ferry, however, there are several issues that must be addressed. The engineering details do not take sea level rise into consideration and a plan should be in place to address future surge. The CAC recommends a program of beach renourishment to begin by pumping sand from the east and depositing on the State Park beach to the west or bring in clean sand by truck. Run-off from the impervious parking lot should also be addressed as part of this application. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Peter Meeker, it was RESOLVED to SUPPORT the application of MICHAEL NIAMONITAKIS to construct a 10'X 12' timber pier extension at seaward end of existing fixed pier and for the as-built existing 4'X 70' timber dock. Located: 13220 Main Rd., East Marion. SCTM#31-14-12 Inspected by: Doug Hardy, Peter Meeker The CAC Supports the application, however, there is a concern with the fertilized lawn and a 10' non-turf buffer should be installed along the landward side of the bulkhead. There are no docks in the area and the exiting dock could be impacted by a northeast storm. The docking facility should not restrict the public right-of-way. Vote of Council: All: All Motion Carried Moved by Peter Meeker, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of BREEZY COTTAGE #3-ELENA COLOMBO to repair/replace the foundation and landings. Total square footage of the footprint of the cottage including porch and landings is 1,045 sf. Located: 65490 Route 25, Greenport. SCTM#53-5-12.6 Inspected by: Doug Hardy, Peter Meeker The CAC Supports the application with the Condition the project conforms with FEMA and Suffolk County Health Dept. standards. 3 Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Peter Meeker, it was RESOLVED to SUPPORT the application of WALTER & BARBARA FITZGERALD to install a 16'X 30' gunite swimming pool with cartridge filter system and associated fence. Located: 8915 Soundview Ave., Southold. SCTM#59-6-27.3 Inspected by: Doug Hardy, Peter Meeker Vote of Council: Ayes: All Motion Carried Moved by Peter Meeker, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of ALAN B. LITNER to reconstruct a deteriorated 1,503 sf. wood deck, ramp and stair in-kind. Located: 1025 North Sea Dr., Southold. SCTM#54-4-12 Inspected by: Doug Hardy, Peter Meeker The CAC Supports the application with the Condition gutters, leaders and drywells are installed to contain run-off, the deck is reconstructed using non-treated lumber and the project complies with FEMA. Vote of Council: Ayes: All Motion Carried Moved by Peter Meeker, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of BENJAMIN & SIOBHAN MORDEN to construct 3'X 6' steps leading to a 4'X 52' fixed kayak dock (equipped with light, water and electricity), consisting of an elevated 4'X 44' fixed timber catwalk (with open-grate decking) and 4'X 8' stairs to grade at seaward end. Located: 801 Maple Lane, Southold. SCTM#64-1-30.2 Inspected by: Doug Hardy, Peter Meeker The CAC Supports the application with removable/seasonal stairs on the seaward end of the dock and questions the overall length of the docking facility and whether it exceeds 1/3 across the width of the creek. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of LOIS ANDERSON to maintenance dredge an area along the southwesterly bulkheading to a depth of-3' during average low water. Proposed maintenance dredging area measures 3,500 sq. and will result in approx. 200 cy. of dredge spoil to be kept on site, deposited along the southeasterly shoreline (landward of the apparent high water mark) to dewater, then grade/groom and plant with native vegetation. Siltation fencing will 4 be installed along the seaward side of the deposited dredge spoil to prevent any sediments entering the contiguous surface waters. Dredged area will include for 1:3 slopes along the edges for stability. Located: 2515 Calves Neck Rd., Southold. SCTM#70-4-45.5 Inspected by: Doug Hardy, Peter Meeker The CAC Supports the application, however, questions the total square footage of the floating docks. Vote of Council: Ayes: All Motion Carried Moved by Peter Meeker, seconded by Doug Hardy, it was RESOLVED to NOT SUPPORT the application of 430 WSD, LLC to add a 13'X 47.9' porch to existing house and 18'X 36' in-ground swimming pool, drywells for pool and maintain a 10' non-turf buffer. Located: 430 West Shore Dr., Southold. SCTM#80-5-2.1 Inspected by: Doug Hardy, Peter Meeker The CAC does Not Support the application because the project was not staked, the property was not properly posted, there is no drywell for the pool backwash and the setbacks are questionable. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Keith McCamy, it was RESOLVED to SUPPORT the application of THOMAS MACARI to construct a 106 If. vinyl retaining wall and 12 If. return along existing eroded bank and provide a 10' non-turf buffer. Located: 1320 Little Peconic Bay Rd., Cutchogue. SCTM#111-14-19 Inspected by: John Stein, Keith McCamy Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of JAY QUARTARARO to construct a swimming pool measuring 18'X 36', proposed surrounding at-grade patio 756 sf., surrounding pool fence 172', pool equipment 55 sf. and pool drywell. Located: 4284 Wunneweta Rd., Cutchogue. SCTM#111-14-27.1 Inspected by: John Stein, Keith McCamy The CAC Supports the application, however, the work has already commenced and there should be a drywell to contain the backwash from the swimming pool. Vote of Council: Ayes: All Motion Carried 5 Moved by John Stein, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of PETER & DIANA O'NEILL for the existing 4'X 135' wood walk and steps from top of bank to wood deck (in part 29'X 8') and in part (29'X 16') landward of bulkhead, 16.2'X 30.4' boat house, two 15' bulkhead returns, and 15' dilapidated bulkhead with 5' return. Located: 5875 Vanston Rd., Cutchogue. SCTM#118-1-1.3 Inspected by: John Stein, Keith McCamy, Jack McGreevy The CAC Supports the application, however, there is a concern with stormwater run-off from the upland structures. The CAC recommends the improper drainage be addressed. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of DAVE BOFILL for the existing 9.1'X 11.4' shed with wood ramp, 4'X 23' wood steps on south side of property and 4'X 10' wood steps on north side of property, both seaward of top of bank and 4'X 4' landing with 4'X 24' steps to 4'X 10' wood walk to irregularly shaped wood deck 42'X 12' to a step and 10'X 15' wood deck with 11.8'X 8.7' shed on deck. 13' wood tie wall along seaward side of toe of bank remains of 22' wood bulkhead and 48' of functional wood bulkhead. Located: 5785 Vanston Rd., Cutchogue. SCTM#118-1-1.4 Inspected by: John Stein, Keith McCamy, Jack McGreevy The CAC Supports the application, however, there is a concern with stormwater run-off from the upland structures. The CAC recommends the improper drainage be addressed. It was also noted that all the trees on the north side of the property were cleared with the exception of one oak tree. McCALL to repair and resurface existing concrete bulkhead built prior to 1970, consisting of resurfacing with 6" of new reinforced concrete, fill on landward side to be removed, stored and replaced when work is completed. Excavation will be done by hand to minimize impact on existing wall. The creek side is partially submerged at high tide so repairs will be incremental and a temporary silt barrier will be set up when work is underway. Located: 10140 New Suffolk Ave., Cutchogue. KEIL to construct approx. 126 If. of vinyl bulkhead in place of existing timber bulkhead and construct 29' vinyl return in place of existing timber return; backfill landward of new bulkhead approx. 50 cy. of clean sand to be trucked in from ' 6 an approved upland source; establish a 10' non-turf buffer landward of new bulkhead; remove remaining portion of previously existing dock (and associated pilings) and construct in its place a new fixed timber dock (equipped with water and electricity) consisting of a 4'X 48' fixed timber catwalk, 3'X 20' ramp and 6'X 20' floating dock secured by two 10" dia. piles. Located: 2045 Westview Dr., Mattituck. SCTM#107-7-3 Inspected by: Keith McCamy Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Keith McCamy, it was RESOLVED to SUPPORT the application of ELIZABETH M. SHEEHAN FAMILY 2012 TRUST to construct approx. 232 If. of vinyl bulkhead in place of existing timber bulkhead to be removed; construct 36' section of shore-perpendicular bulkhead/retaining wall in place of 26' section of bulkhead and 36' section of landward retaining wall to be removed; remove and replace 10' section of timber retaining wall with vinyl bulkhead; remove and replace (inkind/inplace) existing 4'X 5' platform, 4'X 19' stairway, 9'X 11' landing deck, and 4'X 8' beach steps; backfill with approx. 100 cy. of clean sand to be trucked in from an approved upland source; revegetate 12' wide areas adjacent to new bulkheading with Cape American beach grass; and restore and revegetate all disturbed portions of naturally vegetated slope landward of new 138' vinyl bulkhead with native vegetation, including Virginia rose and northern bayberry. SCTM#123-7-11.1 Inspected by: John Stein, Keith McCamy Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Doug Hardy, it was RESOLVED to SUPPORT the application of RICK NAPPI for the demolition of the first floor as a result of finding extensive termite damage and reconstruct dwelling in accordance with Wetland Permit#8593. Located: 5218 Great Peconic Bay Blvd., Laurel. Located: Clay Point Road, Fishers Island. SCTM#2-1-12.1 The CAC did not make an inspection, therefore no recommendation was made. Located: Clay Point Road, Fishers Island. SCTM#2-1-12.2 7 The CAC did not make an inspection, therefore no recommendation was made. DISCUSSION AND RECOMMENDATION TO AMEND WETLAND AND COASTAL EROSION PERMIT APPLICATIONS GAYLE B. WALLACE to Amend Wetland Permit#1866 to maintain the existing dock and ramp consisting of a platform 8'X 11', walkway 3'X 25', aluminum ramp 3'X 19' and floating dock 5'X 30'. Located: Harbor Lane ROW, Cutchogue. SCTM#136-1-3&4 The CAC did not make an inspection, however, the square footage of the floating dock exceeds 120 sf. per Chapter 275. Jack McGreevy will attend the next regular meeting of the Board of Trustees scheduled for Wed., October 21, 2015 at 5:30 PM. The next meeting of the Conservation Advisory Council has been set for Tues., November 10, 2015 at 4:30 PM to be held at Down's Farm Preserve.
