I found that there were two non-code complying items: 1. Railing was not 36" high, and space between balusters was more than 4". 2. Insufficient hold-down connections between footings and porch posts. Both of these item have been corrected. A new railing and proper hold-downs have been installed. "as built" accessory shed originally constructed in 1978-9, in a side yard area,where a rear yard area is required. ADDITIONAL INFORMATION: The property straddles two streets, has two front yard areas, and does not have any conforming rear yard area. No letters were submitted by any of the neighbors that stated any objections to the applicant's request for the variances. The accessory shed did receive building permit #19180 issued July 9,. 1990, for the replacement of the original shed that had been first constructed in approximately 1978-79. This happened apparently without the need for a variance, even though the shed existed in an actual side yard location. The "as built" porch and shed on the subject property were originally constructed in the 1970's. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board fmds the following facts to be true grid-relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The "as built" porch and shed have existed since their construction, in their exact locations for almost 40 years. The quaint, upscale community was developed in the early 1900's as a clutter of"cottages" directly associated with a large resort hotel complex. The nearby main multi-story wood frame hotel structure was subsequently demolished shortly after WWII, when such grand buildings had become somewhat out of fashion. At that time the "cottages" were sold on separate parcels to individual owners. With the onset of modern zoning code, the "cottages"were each granted an existing, but non- conforming status. Because the construction took place many years ago, was done by the original owners who purchased the property from the hotel owners, and because there are numerous other non-conforming "cottages"/single-family dwellings and accessory structures also existing nearby, grant of these specific variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The "as built" porch cannot be feasibly built without a variance for a non-conforming front yard setback because the existing single-family dwelling already has a non- conforming 3.9 ft. setback from Lower Shingle Hill Rd., and a large portion of the dwelling is actually constructed within a non-conforming front yard setback area. The"as built" accessory shed cannot be located in a conforming area because the property technically has two front yards and no rear yard area, therefore the shed requires a variance for the side yard location. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 89% relief from the code for the 4 ft. front yard setback porch, and 100% relief for the side yard location of the shed. However, the existing dwelling was built in the early 1900's, with the existing 3.9 ft. front yard setback. Most of the house is actually within a non-conforming area because of the two front yards. The porch is a relatively small, 110 sq. ft. un-conditioned space, and has a slightly larger setback of 4 ft. The shed cannot be located in a conforming rear yard because such an area does not exist. Lower Shingle Hill Rd. is a private service road, generally traversed only by vehicles owned by the residents of the immediate neighborhood,their guests, and other vehicles occasionally required to be there for work related purposes. 4. Town Law $267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental-conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-b. I have also been asked to investigate the condition of the plumbing and heating systems in the house. There are four items that need to be addressed from the inspection. We are actively working on these, and here is a progress report: 1. Skylights in need of repair– this work has been completed. 2. Permits for: 1) the roofed porch in the rear corner of the house; and 2) the open deck in the front of the house – these will require zoning variances and we are preparing the application material now. 3. 8' x 12' shed in the side yard – this is currently under review by Damon. 4. Heating system (house to be insulated to meet energy code) – see below. The original house dates from 1918. There was a one-story addition that was added in 1962. The non-permitted porch and deck were added before 1974. Of the original house, we know from records at the local library that the floor plans and the overall structure have not been altered since originally built. The house is supported on granite piers, except there is a small basement—eleven feet square—that is original to the house and backs up to the house's central masonry chimney stack. The house has been well maintained, is structurally sound, and is in good condition. All of the domestic hot and cold water piping in the original house is of the black iron type. This type of water supply piping was obsolete by the 1950's, so we know that a heating source was in the original house very early on. This heating source and later boilers were all located in the basement. The house has an oil-fired boiler in the basement providing radiant baseboard heat throughout, but of two different types. There is radiant heat in the 1962 addition, which was installed when the addition was built. The baseboards from 1962 are clearly of a newer type than what exists in the original house. The baseboards in the original house are classic 1950's American Standard types and are positively dated to 1956 or before. There are also three other radiators on interior walls that have painted steel covers dating from the 1940's to early 1950's. All of the radiator piping is copper, but a visual inspection of the color of the radiator pipes makes it obvious that there are newer pipes and older pipes. The newer pipes supply the 1962 addition; the older pipes supply the original house. My investigations in the house lead to the conclusion that the heating system was in place prior to 1957.
