Wireless facilities deployment (a) Facility modifications (1) In general --- Notwithstanc'ing section 704 of the Telecommunications Act of 1996 (Public Law 104-104) or any other provision of law, a State or local government may not deny, and shall approve, any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station. (2) Eligible facilities request - For purposes of this subsection, the term "eligible facilities request" means any request for modification of an existing wireless tower or base station that involves - (A) collocation of new transmission equipment; (B) removal of transmission equipment; or (C) replacement of transmission equipment. (3) Applicability of environmental laws - Nothing in paragraph (1) shall be construed to relieve the Commission from the requirements of the National Historic Preservation Act [16 U.S.C.470 et seq.] or the National Environmental Policy Act of 1969 [42 U.S.C.4321 et seq.]. (0) Federal easements and rights-of-way (1) Grant - If an executive agency, a State, a political subdivision or agency of a State, or a person, firm, or organization applies for the grant of an easement or right-of-way to, in, over, or on a building or other property owned by the Federal Government for the right to install, construct, and maintain wireles - service antenna structures and equipment and backhaul transmission equipment, the executive agency having control of the building or other property may grant to the applicant, on behalf of the Federal Government, an easement or right-of-way to perform such installation, construction, and maintenance. (2) Application - The Administrator of General Services shall develop a common form for applications for easements and rights-of- way under paragraph (1) for all executive agencies that shall be used by applicants with respect to the buildings or other property of each such agency. (3) Fee (A) In general - Notwithstanding any other provision of law, the Administrator of General Services shall establish a fee for the grant of an easement or right-of-way pursuant to paragraph (1) that is based on direct cost recovery. (B) Exceptions - The Administrator of General Services may establish exceptions to the fee amount required under subparagraph (A)- (1) in consideration of the public benefit provided by a grant of an ease .ant or right-of-way; and (ii) in the interest of expanding wireless and broadband coverage. (4) Use of fees collected - Any fee amcunts collected by an executive agency pursuant to paragraph (3) may be male available, as provided in appropriations Acts, to such ag,ncy to col,,:r the costs of granting the easement or right-of-way. (c) Master contracts for wireless facility sitings (1) In general — Notwithstanding section 704 of the Telecommunications Act of 1996 or any other provision of law, and not later than 60 days after February 22, 2012, the Administrator of General Services shall — (A) develop 1 or more master contracts' that shall govern the placement of wireless service antenna structures on buildings and other property owned by the Federal Government; and (B) in developing the master contract or contracts, standardize the treatment of the placement of wireless service antenna structures on building rooftops or facades, the placement of wireless service antenna equipment on rooftops or inside buildings, the technology used in connection with wireless service antenna structures or equipment placed on Federal buildings and other property, and any other key issues the Administrator of General Services considers appropriate. (2) Applicability — The master contract or contracts developed by the Administrator of General Services under paragraph (1) shall apply to all publicly accessible buildings and other property owned by the Federal Government, unless the Administrator of General Services decides that issues with respect to the siting of a wireless service antenna structure on a specific building or other property warrant nonstandard treatment of such building or other property. (3) Application — The Administrator of General Services shall develop a common form or set of forms for wireless service antenna structure siting applications under this subsection for all executive agencies that shall be used by applicants with respect to the buildings and other property of each such agency. (d) Executive agency defined — In this section, the term "executive agency" has the meaning given such term in section 102 of title 40. (see attached report). We have the following recommendations for this application: 1. The proposed LTE modifications and up-grades are in compliance with the General Requirements of§280-70; however, there are locations within the steeple room where human exposure could exceed FCC limits; therefore RF notice signs should be posted at the entrance and on the walls within the steeple area, (see figure 8 of the CityScape report). 2. We recommend a Building Permit be issued for this application with the above condition, consistent with the plans submitted in this application. ("CityScape"), in its capacity as telecommunications consultant has considered the merits of an application provided by AT&T Mobility ("Applicant") to remove and replace an existing microwave dish antenna mounted within the steeple of the Our Lady of Grace Roman Catholic Church. The proposed microwave antenna being exchanged has an elevation of thirty-six (36)feet above ground. The total elevation of the steeple with the top mounted cross is sixty-six feet and one inch (66' 1"); see figure 1. With the change of microwave antennas the Applicant will add new fourth generation (4G) long term evolution (LTE) electronic equipment inside their existing LTE cabinet located in the Church basement; see figure 2. The subject location is Our Lady of Grace Church and is physically located at Oriental Avenue and Ettrick Avenue in the Town of Southold jurisdiction; see figure 3. LTE is the Applicant's version of advanced 4G technology, which will provide for high(er) speed wireless broadband implementation, aimed directly at today's Smartphones, and in the near future,the speeds should improve even more. The proposed plans will not alter the configuration of the existing system antennas just a 25% increase in the size of the microwave antenna. None of the proposed changes will require an electrical permit. The Applicant had proposed more extensive upgrades in December of 2013 which utilized the smaller microwave dish, however they apparently discovered that the proposed three (3) foot microwave antenna was unsatisfactory to provide sufficient signal to the desired hand-off location in Connecticut. A microwave path is the only possible way to enable AT&T communications to obtain the download and upload communications speeds for future wireless broadband data transfer across a two (2)mile water path. The current technologies currently being developed and even more so the future technologies demand interconnectivity substantially better than the current wide-spread copper wire systems. Advancing technologies are currently being constructed; all facilities will be replacing the standard copper wire circuits with either fiber optic cable or a microwave link. This is the only known way which will provide for transfer of data at the speeds most of America desires now and the future demands will be substantially higher speeds. June 26,2014 Telecommunications Site Review Page 2 New York Concealed Facility Upgrade Fisher Island is approximately 2.5 miles off shore from the closest point in the State of Connecticut. It is not a reasonable consideration to install a fiber optic cable that distance underwater because the cost verses the benefits would not be practical, especially when microwave systems will meet all the requirements. Therefore the best option to transfer this data from the mainland to Fishers Island is microwave; the cost is limited to the initial capital equipment investment,the installation cost and any required lease fees for equipment locations. The microwave path from the Church is 23.25 degrees True, see figure 4. An existing water tank in West Mystic Connecticut appears to be the send/receive origination point, see figure 5. All proposed antenna changes occur within the Church steeple and thus will not cause any overload concern. To assure the structural limits, the Applicant submitted a Church Steeple Evaluation dated May 15,2014;however in this situation it was not necessary since the equipment is not exposed and does not have a wind load impact; see figure 6. The only potential structural consideration would be the deadweight of the increased microwave antennas and its mounting tripod, which is minimal; see figure 7. The Applicant submitted an RF Exposure Analysis dated May 15, 2014, providing calculations to assure compliance with all Federal Communications Commission (FCC) standards regarding human exposure to Radio Frequency (RF) energy. The provided information was not essential because the report only addressed the radiation exposure at six (6) feet above ground. RF exposure calculations or measurements are rarely needed for any wireless facility. There are certain occasions that exposure levels could be a concern but only when there is human access within close proximity to the various transmitting antennas, normally only for rooftop or radio equipment room installation. This particular facility does have that concern. There are locations within the steeple room where human exposure could exceed the FCC limits; therefore RF notice signs should be posted at the entrance and on the walls within in the steeple area, see figure 8. The Applicant is aware of these limits and has stated they will comply with federal guidelines regarding human exposure to radio frequency energy and will comply with rules concerning interference to other radio services,see figure 9. This application does not meet the standards as described in the recently passed Middle Class Tax Relief and Job Creation Act of 2012 therefore it is not qualified for streamlined processing.
