HomeMy WebLinkAboutL 12119 P 93CONSULT YOUR LAWYER BEFORE SIGNING THIS INSTRUMENT-THIS INSTRUMENT SHOULD BE USED BY LAWYERS ONLY THIS INDENTURE, made the '~ ~/'Jq day of May, 2001 BETWEEN ELIZABETH BLAKE SCHWIEGER, as Trustee of the ELiZABETH BLAKE SCHWIEGER LIVING TRUST dated September 8, 1998, residing at 800 Lighthouse Road, Southold, New York 11971 party of the first part, and DOUGLAS O'BRIEN and EILEEN GP, IFFI~ husband and wife, both residing at 338 Bloomfield Street, #4, Hoboken, New Jersey 07030 party of the second part, WITNESSETH, that the party of the first part, in consideration of One Hundred Sixty Thousand and no/~0Oths ($160,000.00) dollars paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southoid, County of Suffolk and State of New York, being more particularly described as follows: BEGINNING at the point on the northeasterly side of Lighthouse Road which point marks the northwesterly corner of the premises herein described and the southwesterfy corner of land of Stares formerfy of OIsen and Meyers, said point being 1,211.17 feet southeasterly from the corner formed by the southeasterly side of Sound View Avenue with the northeasterly side of Lighthouse Road and from said point or place of BEGINNING. RUNNING THENCE North 48 degrees 41 minutes 40 seconds East 506.66 feet to a point; RUNNING THENCE South 27 degrees 54 minutes 10 seconds East 179.90 feet to a point; RUNNING THENCE South 48 degrees 41 minutes 40 seconds West 464.96 feet to the northeasterly side of Lighthouse Road; RUNNING THENCE along the northeasteHy side of Lighthouse Road, North 41 degrees 18 minutes 20 seconds West 175.0 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from Helen Howard dated September 30, 1998 and recorded in the Suffolk County Clerk's Office on January 27, 1999 in Libor 11942 cp 001 and by a Confirmatory Deed from Helen Howard dated April 13, 2001 to be recorded simultaneously herewith. SUBJECT TO a covenant and restriction, which shafl run with the land, prohibiting the building of any structure(s) on the subject premises prior to the earlier of the expiration of five (5) years from the date of this deed, or the bona fide sate of the adjoining premises commonly known as 800 Lighthouse Road, Southold, New York, owned by ELIZABETH BLAKE SCHWIEGER. A transfer of title to said adjoining premises pursuant to a will or trust of said Elizabeth Blake Schwieger shall not be deemed a bona fide sale for the purposes of this covenant and restriction. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and wilt apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
