THIS INDENTURE, made the day of October nineteen hundred and Seventy—five
BETWEEN EMANUEL TSONTOS, residing at 260 Jericho Turnpike, Mineola,
New York and STEPHEN TSONTAKIS, residing at P. O. Box 791, Middle
Road, Mattituck, New York
party of the first part,and M S T CONSTRUCTION CORP. , a domestic corporation,
having an office at P. O. Box 791, Middle Road, Mattituck, New YorK
party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration:
paid by the party of the second part, does hereby grant and release unto the party of the second part,the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying andbeing7p1cEh7C at Mattituck, in the Town of Southold, Suffolk County,
New York, more particularly bounded and described as follows:
BEGINNING at a point on the northwesterly line of Luther 's Roa:1,
which point is distant 234.31 feet Northeasterly from the division
line between other land now or formerly of Sledjeski and land of
Guyton; from said point of beginning running thence along other lanC
now or formerly of Sledjeski the following seven (7) courses and
distances as follows: (1) on a curve to the right whose radius is
25.00 feet, a ditance of 39.27 feet; (2) North 710 34 ' 00" West,
50.00 feet; (3) Thence along the' arc of a curve to the right whose
radius is 283.58 feet for a distance of 98.99 feet, (4) North 510
34' 00" West, 97.64 feet; (5) Thence along the arc of a curve to tee
right whose radius is 225.69 feet, a distance of 159.07 feet;
(6) North 110 111 00" West, 80.00 feet; (7) North 780 49' 00" East,
267.00 feet to land now or formerly of Charles Kleinschmidt; running
thence along said land now or formerly of Kleinschmidt three (3)
courses and distances as follows: (1) South 110 ill 00" East, 80. 00
feet; (2) South 170 42 ' 00" East, 226.55 feet; (3) South 710 33 , 001,
East, 17.05 feet to the northwesterly line of Luther's Road; runninS
thence along said northwesterly line of Luther 's Road South 180 263
00" West, 75.00 feet to the point or place of beginning.
SUBJECT TO a mortgage in the sum of $25, 500.00 held by Stanley
Sledjeski and Helen Sledjeski.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenance,
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the part), of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party o7
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indentpre so requires,
