This Indenture,made the 31st day of Decembe;nineteen hundred and seventy five
Between C. RICHARD RUTTAN residing at 20 Pinecrest Parkway,
Hastings–on–Hudson, New York

JOSEPH MASCIA and HELEN J. MASCIA, his wife, both residing
at 60-23 69th Lane, Maspeth, New York
party of the second part,
Witnesseth, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by
it, the party of the second part, does hereby grant and release unto the party of the second part,the heirs or successors

All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,situate,lying and
tie!nglnthe at Nattituck, 'Town of Southold, county of Suffolk and State
of New York, bounded and described as follows : BEGINNING at a concrete
monument set on the southwesterly line of Deep Hole Drive at the
southeasterly corner of land now or formerly of Anthony Corte , and
�C running along said southwesterly line of Deep Hole Drive, South 30°
11' 20" East 50 feet to land now or formerly of O'Keefe; thence along
4 said land of O'Keefe at right angles to said southwesterly line of
Deep Hole Drive, South 59° 48' 40" West 213. 0 feet, more or less , to
the ordinary high water mark of Deep Hole Creek, running thence along
Deep Hole Creek as measured along a tie line North 780 25 ' 40" West
75 . 07 feet to said land of Anthony Corte; thence along said land of
Anthony Corte, parallel with the Southeasterly boundary hereinabove
described North 59° 48 ' 40" East 269 . 0 feet to the point or place of
beginning.
TOGETHER with all the right, title and interest of the parties of the
first part in and to the waters and land under water at Deep Hole
Creek lying in front of and adjoining the above described premises.
TOGETHER with all the right, title and interst of the parties of the
first part in and to Deep Hole Drive adjoining said premises to the
center line thereof.
SUBJECT to zoning ordinances oriestrictions enacted by any Town,
Municipal, State of Government Authorities.
j BEING and intended to be the same premises conveyed to the parties
of the first part herein by Joseph Gladstone and Ruth Gladstone his
wife, by deed dated October 19 , 196V and
recorded In Liber 4903 Cp
520 on November 22 , 1960
Together with a!I right, title and interest, if any, of the party of the first part in and to any streets and roads abutting
the above described premises to the center lines thereof; Together with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;To Have And To Hold the premises herein granted unto the
party of the second part,the heirs or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever,except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the parry of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the pay
ment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party"shall be construed as if it read "parties"whenever the sense of this indenture so requires.
In Witness Whereof, the party of the first part has duly executed this deed the day and year first above written.
