BRADY, being duly sworn, deposes and says: That ali statements contained herein are true to the best of my knowledge and belief, that I am the owner of the property known as 7180 Peconic Bay Boulevard, Laurel, New York ("the property"), that all repairs and reconstruction work done to the property owing to storm damage suffered on or about March 28, 1984, such repairs and reconstruction being conducted from June, 1984 to on or about June 3, 1985 fell under a General Permit issued by the New York State Department of Environmental Conservation (the D.E.C.) Regulatory Affairs Unit entitled: "Region 1 Special Ice and Storm Damage General Permit" which was pursuant to Tidal Wetlands Act, Article 25 and the Uniform Procedures Act, Article 70 (Part 621.14 Special Provisions) of the New York State Environmental Conservation Law, and which states: "All persons, governmel~ttl agencies or corporations desiring to conduct repairs or reconstruction which fits the following criteria: 'Redriving or replacing openwork dock or openwork pier piling, and mooring piles, removal of damaged piling, repair or replacement of floats, docks on pilings, ramps, catwalks, decking, stairways, bulkheads, retaining walls, as necessitated by ice and storm damage occ~rr/tng between January 1, 1984 and March 31, 1984 in Nassau and Suffolk Counties' will be eligible for a General Permit," and that Ed Hindermann, Building Inspector, Town of Southold, Office of Building Inspector, Town Ball, Southold, New York stated in a letter to G. A. Brady (now deceased), my mother and previous owner of the property, dated October 25, 1984 that "Under Wetlands, Chapter 97, Code of the Tow~ of Southold, Art. 1-Sec. 97-12 A (5) a permit is not required to make an "in place" replacement and repair of [thel presently existing bulkhead, and that all authorization was granted by the General Permit of the D.E.C. to the U.S. Small Business Administration to grant a loan to G. A. Brady "to rehabilitate or replace property damaged or destroyed by disaster occurring in the month o~'~arch 1984," specifically for items or areas "to repair/replace disaster damaged personal property in similar kind and quantity, to repair/replace disaster damaged landscaping, to fill and regrade disaster eroded areas, to repair/replace disaster damaged walk(s) and Driveway(s), to repair/relate disaster damaged septic system, for disaster clean-up and debris removal expenses inccured at [the property], to repair/replace other disaster damaged land improvements, including gate, deck, flag pole, and cabana doors, [and] to repair/replace bulkheads," on July 3, 1984, and that such rehabilitation and replacement of disaster damaged property was done in accordance to said General Permit Art.70 (621.14 Special Provisions).
