Southold Town Building Zone Ordinance Board of Appeals June 6, 1957 A regular Meeting of the Board of Appeals was held at the Town Clerk's office in Southold, N. Y., on Thursday, June 6, 1957, at ?:30 P.M. Present were: Mr. Gillispie, ~. Rosenberg, mr. Gregonis &Mr. Bergen. Also: Mr. Howard Terry, Building Inspector and ~r. R. G. Terry, Jrt, Town Oounsel. Absent: Mr. Serge Doyen. CHARLES L. DOUGHERTY, representing ~. henry J. Smith, owner of lots at ~ill Colony, stated that iv~. Smith had decided to cut lots i and 2 into one lot and lots 3 and 4 into another lot. Lot 5 to be sold the way it is as it is a fringe area case. Lots 6, 7 and 8 to be considered as two lots. The board advised that an appeal would have to be filed for a variance.. Public hearing to be ~eld on Thursday, June 20th, at the Town Clerk's office at 7:30 P.M. WALi~R G. Mr. Kapp advised that he had been to the Town Board and asked them to establish an open development area for this particular property. He has received a report from the Planning Board in which they suggested asking the Board of Appeals for an area variance. Lot 6 has 0een sold. This lot was in single and separate ownership before the ordinance went into effect. The board agreed that no variance would be needed before a building permit could be granted on this lot. ~. Kapp said he would need a right-of-way and assumes that the planning board will grant an access to the property. ~o decision was made by the board at this time. Discussion was then held on the forthcoming public hearing to be held in ~attituck on ~une 7th. The board asked ~r. Terry, Town Counsel, what his opinion was regarding oath to be used a t public hearings. ~r. Terry advised that ordinarily no oath would be a~ministered unless counsel for the applicant wished to offer a sworn testimony. In such a case, the board may elect to have all of the hearing under oath. in case of a sworn testimony the Chairman would administer the follov~ng oath: Raise your right hand. Do you solemnly swear that the testimony you are about to give is the truth, the vJhole truth and nothing but the truth, so help you God? June 6, 1957 Southold Town Building Zone Ordinance-Board of Appeals MINUTES, Continued It was decided that in a case where a he,ring would continue until a n unreasonably late hour.the board may elect to continue such hearing at another specified time. No adjournment of the hearing would be necessary unless an attorney for the applicant should ask for an adjeurn- ment and he would then, in all probability, ask for a meeting ~th the board a t a later specified date. ~. Terry then advised that affidavits from both newspapers would have to be obtained and read at the hearing. Petition by the applicant would have to be read plus the letter to Mr. Riley, dated May 31st. The board discussed the matter of removal of buildings and cozmuercial signs on property which is or has been confiscated. It was agreed that a building permit ~vould have to be obtained for the rebuilding of a struc- ture which had been removed. In the case of signs a permit would not be necessary as long as the owner complied with the necessary setbacks. FRANK CLAUDI0 - Mr. Gillispie mentioned that he had received a call from ~r. Claudio pertaining to a sign approximately 30' x 12' which had been removed from leased property in Mattituck due to the sale of this property as the result of condemnation proceedings. Sign has not been replaced and he would like to erect it on a suitable site. It was the feeling of the board that owners of signs which ha6 been removed subject to condemnation proceedings should be permitted to reerect them. Minutes of the ~ay 31st meeting were then read by the secretary. On motion made by ~r. Gregonis, seconded by ~. Bergen and carried, minutes were approved. ~eeting adjourned at 11:50 P.M.
