Southold Town Building Ordinance - Zoning
Board of Appeals
July 25, 1957
A regular meeting of the Zoning Board of Appeals was held at the Town Clerkts
office in Southold, N. Y., on Thursday, July 25, 1957, at 7:30 P.M.
There were present: ~r. R. W. Gillispie, Jr., Chairman
Mr. Robert Bergen
~Ir. Herbert Rosenberg
Also: Mr. Howard M. Terry, Building Inspector
Absent: Mr. Charles Gregonis and };~. Serge Doyen
Mr. G. Nickles, Main Road, Southold, N. Y., asked the ~oard if it were possible to
obtain an immediate variance on Lot No. 12, Block 2, on m~p of Beixedon Estates. Lot
on ~p No. 1472 filed in Suffolk Couuty Clerkts Office on 5~rch 16, 1946. Size of lot:
75t x 290t, on which a house was built in AUgUSt of 1955. On July 8, 1957, Mr. Nickles
drew up contract of sale aud t.he m~u buying the house lives in Peconic and he is clos-
ing his property out on July 26th and l~r. Nickles h~d guaranteed him occupancy to house
on Lot 12 on Au~st 1st. Board advised l{r. Nickles that he would bare to apply for
the variance thro~gh the usual chan~els and legal notices would have to be published
before a public hearing could be held.
Mr. P. V. Murphy, West View Drive, Mattituck, N. Y. Mr. Murphy advised that he h~d
read notices in the papers regarding appeal of Mr. Braun for ~ v~riance and questioned
the reason for the variance. Board ex~_lained to Mr. Murphy that the lot in question
was undersized and did not conform to the Zoning Ordin.nce and in order to ~uild on a.u
undersized lot the owners of such a lot would have to receive a variance from the board
of appeals before the ~uilding inspector could issue a ~uilding permit.
PUBLIC HEARING - Appeal No. 10 - Upon application of William and RobertinaBra~n
of 18th Street, Jericho, N. Y., for variance to Zonind Ordinance, Article III, Section
303. Lot No. 28, 75~ x 170! on William and Harry Nason~s m~p of "Westview", east side
of ~attituck Creek, Mattituck, ~. Y.
After introduct2on of the members of the board, letter to Mr. & Mrs. Brs~un advising
them of date of hearing, legal notices and affidavits from two official town newsp~pe~s
and petition for variance were all re~d by the Chairman.
Chairman: "Is there anyone present who wishes to speak "for" this aopeal?"
"~uyone wishing to spe~k ~against" appeal?"
Board reviewed appeal and studied map.
0hairman: "There being no objections to this ~ppeal and lots on either side of
Lot 28 bein~ comoletely ~ilt up, it is the unanimous decision ofthe ~oard that appeal
~e granted. ~

HEARING ENDED.
Discussion was held regarding the present Zoning Ordinance and it was decided to
t~ve the Secretary write Commissioner Dickenson ofthe Department of Commerce in Albany
to try and procure copies of the booklet "Loczl Plenning and Zoning" for each member
of the ~oard.
Minutes o£ the July llth meeting were read. Upon motion m~de by Mr. Rosen~erg
and seconded ~yMr. Bergen, and carried, minutes were approved.
Next meeting to be held on Thursday, August l, 1957.
