Barnitz part ies of the second part: 191tntsset4,That the part ies of the first part, by virtue of the power and authority to the executors given in and by the said last Will and Testament, and in consideration of ($ 1.00 ) lawful money of the United States, One Dollars, paid by the part ies of the second part, do hereby grant and release unto the part ies of the second part, their heirs and assigns forever, all that certain plot, piece of parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Indian Neck, Peconic, in the Town of Southold, County of Suffolk, and State of New York, bounded and described as follows: BEGINNING at a point on the curved westerly line of Robinson Lane at the southeast- erly corner of premises heretofore conveyed by Nelson S. Robinson to Mary vanZyver- den by deed recorded in Liber 5096 of deeds at page 205 (and which point is the- northeasterly corner of Lot No. 2 on a certain map entitled "Map of Peconic Bay Oaks" filed in the Suffolk County Clerk's Office on October 18, 1961, as Map No.. 3434) ; running thence in a southeasterly direction along the westerly line of Robinson Lane on a curve to the right having a radius of 725 feet a distance of 18 feet, more or less, to a point which is 15 feet southerly of the northerly line of said Lot No. 2 when measured at right angles thereto; running thence South 77 degrees 26 minutes 10 seconds West a distance of 140 feet, more or less, to the easterly line of land now or formerly of ,Messenger; running thence along said land of Messenger, North 12 degrees 33 minutes 50 seconds West, a distance of 15 feet to the northerly line of said Lot No. 2; continuing thence in the same direction, North 12 degrees 33 minutes 50 seconds West a distance of 110.50 feet to land conveyed by Mary vanZyverden to Henry J. Smith and Stella Smith, his wife; running .L-0 thence along said land of Smith, North 77 degrees 26 minutes 10 seconds East, a distance of 210.92 feet to the westerly line of Robinson Lane; running thence in a southwesterly direction along the westerly line of Robinson Lane on a curve to the right having a radius of 725 feet, a distance of 127.0 feet to the point and place of beginning. TOGETHER with the right to the use, in common with others, of a strip of beach land approximately 15 feet in width, extending along the southerly or southeasterly line of said Lot No. 2 to ordinary high water mark of Peconic Bay. Being the same premises which Mary vanZyverden Barnitz, by deed dated the 5th day of March, 1965, and recorded in Liber 5713, page 476, granted and conveyed unto Harry W. Barnitz and Mary vanZyverden Barnitz, his wife, as tenants by the entireties. AND the said Harry W. Barnitz departed this life on the 1st day of September, 1973 , leaving his wife, the said Mary vanZyverden Barnitz surviving whereby title vested in her alone by right of survivorship; and the said Mary vanZyve_ rden, ' Barnitz Mar A. Ba tz departed this life on the 28th day of ctober, 1991, leaving a last will and testament dated March 3, 1983, which was probated on December 3, 1991, in the Office of the Register of Wills of Montgomery County, Pennsylvania and letters testamentary granted thereon to Anne Barnitz Rose and Wendy Barnitz Barry, co-executors. RECORDED CC Continued on At-r- had Addendum to DeaA_of_.Correction. �]L C R E WAY 12 1995 EDWARD P.Roams CLERK OF SUFFOLK COUNTY 11725 FG241 ADDENDUM TO DEED OF CORRECTION By terms, of said will, testator provided, as to above described real estate, in Article I, paragraph 1: "If I still own my vacation property in Peconic, Suffolk County, New York, I leave said property in trust under the terms and conditions hereinafter set forth". Pursuant to Article II, she did appoint her daughters co- executors as well as co-trustees and by Article III, she established a trust for the benefit of her family. Ancillary letters testamentary were granted to Anne Barnitz, Rose and Wendy Barnitz Barry by the Surrogates Court, Suffolk. County, New York nn July 1 , 1994, as of No. 1198P 1994. This DEED OF CORRECTION is being recorded because the prior deed dated the 26th day of August, - ra November 2, 1994, between the same parties in .1 ibr 11700, page 82 contained the wrong legal description. The Deed , er 2, 1994 described the property adjacent to the property ow d by the Estate, being a property formerly owned by decedent's mo her, Mary vanZyverdpn (now owned by Catherine van7yverden Gdhner) .
