The proposed parking lot requires Zoning Board of Appeals approval pursuant to Article XVIII,
Section 280-78H, which states,
Location and ownership. Required accessory parking spaces, open or enclosed, shall be
provided upon the same lot as the use to which they are accessory or elsewhere,provided that
all spaces therein are located with 200 feet walking distance of such lot. In all cases, such
parking spaces shall conform to all the regulations of the district in which parking spaces are
located, and in no event shall such parking spaces be located in any residence district unless the
use to which the spaces are accessory is permitted in such residence district or upon approval
by the Board of Appeals. Such spaces shall be in the same ownership as the use to which they
are accessory and shall be subject to deed restrictions approved by the Board, binding the
owner and his heirs and assigns to maintain the required number of spaces available either
throughout the existence of such use to which they are accessory or until such spaces are
provided elsewhere (unless municipally owned spaces are utilized in accordance with 280-
78A above).

RE: ZBA Application of Cross Sound Ferry Services, Inc.
Dear Mr. Esseks:
I write at the direction of the Town Board of the Town of Southold in response to
your letter dated October 17, 2007, regarding the above-referenced application. Without
accepting your characterization, clearly the referenced ZBA application has not been
pursued or processed pending the parties' talks. The Town regrets Cross Sound Ferry's
view that the talks have stalled, and remains willing to continue the dialogue toward
productive ends.
With respect to the ZBA application, please recall that the notice of disapproval
issued by the Building Department required site plan approval from the Planning Board,
in addition to ZBA approval. As the review of this application under SEQRA may not be
segmented, and will be coordinated and conducted by the Planning Board and
Department, it is necessary for Cross Sound Ferry to submit a site plan application to the
Planning Board in order to initiate the Town's processing and review of this application.
(Review by the Board of Trustees may also be required.)
Please do not hesitate to contact me with any questions or concerns with respect
to this or any other matter.
