Southold Town Building Zone Ordinance Board off Appeals July 11, 1957 A regular meeting of the Zoning Board of Appeals was held at the Town Olerkts office in Southold, N. ¥., on Thursday, July ll, 1957, at 7:30 P.M. There were present: Mr. 2. W. Gillispie, Jr., Chairman Mr. Robert Bergen Mr. Charles Gregonis ~r. Herbert Rosenberg Also: Mr. Howard M. Terry, Building Inspector Absent: Mr. Serge Doyen Judge Eowell of Nattituck, appeared before the board and presented unfiled map of his property in New Suffolk and asked for advise as to how he could sell his lots and comply with the Ordinance. Board advised that the undersized lots could be divided into six lots of approximately 125' x 100t, this would then comply with the Ordinance. Frank Ash~y of Greenport presented unfiled map of Cove Park, Greenport, N.Y. Mr. Ashby said his lawyer had azlvised him to deed every other lot over to his wife ~nd this was done 3 or 4 days before zonir~g went into effect. Recently, due to the fact that he realized he would need some sort of variance in order to ~uild on these lots, he had Mr. Van Tull draw up a revised map. New map is dated July 8, 1957, but the lots are still undersized. Board ~ivised that the map in itts present form would not be acceptable as the Ordinance requires that a lot be 125t x lO01 and they advised Mr. Ashby to take the matter up with the Planning Board and have them take a look at the property in question. PUBLIC HEARING - Appeal No. 9 - Upon application of Herbert J. Egert, North Road, Greenport, N. Y., for variance to xZoning Ordinance, Article III, Section 303. Lot ~ No. 82 on east side of Gillette Drive, East ~rion, N. Y., on filed map o£ Marion Manor. Size: lO01 x 100t. Wearing convened at 8:20. Members of the Board were introduced. Letter o£ June 29, 1957, to Mr. Egert advising date of hearing, legal notices and affidavits from two official town newspapers and petition for variance were all read by the Chairman. Chairman: "Is there anyone present who wishes to speak "for" this aopeal?" Mrs. Egert: "Yes. I would like to bu~ld a house on this property." -2- Zoning Board of Apoeals July ll, 1957 MINUTES, Continued Chairman: "Is there anyone here who wishes to spe~k "Against" this appeal?" "There being no one wishing to speak "against" this appeal the board is prepared to ms~e an immediate decision." It was the unanimous decision of the board that the variance be granted as it would observe the spirit of the ordinance and would not cha~e the character of the district as ether houses in this district have been built on the ssme size lots. Hearing ended. PUBLIC HEARING - Appeal No. 8 - Application of Henry Troutm~n, Smith Drive, Southold, N. Y., for variance to Zoning Ordins~uce, Article III, Section 304. Lot ~100, south side of Smith Drive, Southold, N. Y., on filed map No. 8015 of Goose ~eck. Map d~ted November 22, 1948. Hearing convened at 8:40. Letter to Mr. Troutman advising him of date of hearing, legal notices and affidavits from two official town newspapers and appeal were read by the Chairman. Chairman: "Is there anyone present who wishes to speak "against" this appeal? Anyone wishing to speak "for"?" There being no response, the board studied this application for permission to build an addition to the present structure. Rough sketch of project accompanied appeal which showed an existing porch that is to be torn down and replaced by the new addition of a bedroom, which would reduce the existing setback by approximately l0 feet. Board agreed that this request for variance be granted as other existing houses in the district are of various setbacks ~nd the granting of this variance would not change the character of the district in question. It was pointed out, however, that Mr. Trout~u would be notified, in the form of a letter, that he would have to observe Section 1006 of the Ordinance pertaining to obsuuri~ of view on a corner lot. Hearing ended. Mr. & Mrs. Hunter of White Plains, N. Y., appeared regarding their lot in "A" Residential zone on Orchard end Third Streets, New Suffolk, which they bought five or six years ago. At the time of purchase a small"shack" existed on the property which they still use as a summer dwelling. A new ~uilding was erected on the lot 4 or 5 years ago. New building 28~ x 22~ on lot 75~ x lC0t. Mr. Hunter would like to sell the new house along with half ofthe lot and then he would tear down the old shack and put up a new building for his own use on the other half of the lot. Board advised that they had absolutely no authority to grant permission to divide the property into two such lots. T hey advised Er. Hunter that he could improve his existing shack as long as he did not change the outside dimension of same. Mr. Terry also advised that the Board of Health would enforce the 65~ minimum from well point to cesspool. Zoning Board of Appeals July ll, 1957 MINUTES, Continued Julius Ze~roski of Mattttuck - Re: Meadowland zoned "A" Residential in Mattituck. Wants to dredge ~0t in existing 40! canal, widening canal to 80t and then sell the upland in small parcels to ~e used as ~oat moorings. Land on unfiled Map made in 1954. Board advised Mr. Ze%roski to take this matter up with the Planning Board as they would be the only ones who could declare this a special district. Next regular meeting to be held on July 25, 1957.
